BILL NUMBER:S4541 TITLE OF BILL: An act to legalize, validate, ratify and confirm certain actions of the Oneonta Fire District relating to its operation PURPOSE: To validate the proceedings and actions of the Oneonta Fire District SUMMARY OF PROVISIONS: Section 1 provides that any actions of the Oneonta Fire District taken from 2010 to the present are hereby validated and ratified. Section 2 provides the effective date. EXISTING LAW: Not applicable. JUSTIFICATION: The Oneonta Fire District, a subdivision of the state located within the Town of Oneonta, Otsego County, appointed commissioners to fill vacancies in the time period of 2010-2014 and through error or omission failed to schedule elections each December subsequent to the appointment of commissioner(s) for the voters to ratify the interim

SEWARD -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to legalize, validate, ratify and confirm certain actions of the Oneonta Fire District relating to its operation THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. All the acts done and proceedings heretofore and hereafter had and taken or caused to be had and taken, by the Oneonta Fire District within the Town of Oneonta and by all officers, employees or agents of such district beginning in the year 2010 and ending upon the legal appointment or election of the commissioners of such district in 2015, where such acts and proceedings are consistent with article 11 of the town law or any other relevant provision of law are hereby legal- ized, validated, ratified and confirmed, notwithstanding any failure or defect of the district to comply with section 175 of the town law during such period. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD10203-02-5
