BILL NUMBER:S5381 TITLE OF BILL: An act authorizing the town of Thompson, Sullivan county, to establish a road improvement district PURPOSE OR GENERAL IDEA OF BILL: To authorize the Town of Thompson to establish a road improvement district in accordance with the provisions of article 12 and 12-A of the Town Law. SUMMARY OF SPECIFIC PROVISIONS: Section 1: Provides the authorization for the Town of Thompson to establish the "Adelaar Road improvement district." Paragraph (b) stipulates that the purpose of the district shall be to provide for the repair, reconstruction and maintenance of roads and related appurtenances within and around the Adelaar development area. Paragraph (c) states that the costs and expenses of the operation of the district shall be paid through the levy of special assessments upon lots within the district. Paragraph (d) authorizes the Town and the district to issue bonds and notes pursuant to the provisions of the local finance law applicable to special improvement districts. Section 2: Provides that if any provision of this act or the application thereof to any person or circumstance is adjudged invalid by a court of competent jurisdiction, such judgment shall not affect or impair any other provisions or applications of this act which can

BONACIC -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT authorizing the town of Thompson, Sullivan county, to establish a road improvement district THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. (a) Notwithstanding any other provision of law to the contrary, the town of Thompson, in the county of Sullivan, shall be authorized and enabled to establish a special improvement district to be known as the "Adelaar Road improvement district". Such district shall be established in accordance with the provisions of article 12 and 12-A of the town law for the establishment, funding and operation of special improvement districts. (b) The purpose of the Adelaar Road improvement district shall be to provide for the repair, reconstruction and maintenance of roads and related appurtenances within and around the Adelaar development area as defined by the town of Thompson town board to ensure certain upgrades, improvements and repairs are made pursuant to certain development crite- ria established by the town of Thompson. (c) The costs and expenses of the operation of the Adelaar Road improvement district shall be paid through the levy of special assess- ments upon all lots or parcels of land within such district either in proportion to the benefit derived therefrom or on an equal basis. (d) The town of Thompson and the Adelaar Road improvement district are hereby authorized to issue bonds and notes pursuant to the provisions of the local finance law applicable to special improvement districts. S 2. Severability. If any provision of this act or the application thereof to any person or circumstance is adjudged invalid by a court of competent jurisdiction, such judgment shall not affect or impair any other provisions or applications of this act which can be effected with- out the invalid provision or application, and to this end the provisions of this act are severable. This section also provides that any development criteria, construction or reconstruction and subsequent maintenance thereof shall be in accordance with the applicable provisions of the Highway Law and the procedures of the Department of Transportation. The town of Thompson, in the county of Sullivan, is hereby authorized to establish a special road improvement district pursuant to articles 12 and 12-A of the town law. Such road improvement district shall be established, funded, operated and otherwise controlled by the provisions of articles 12 and 12-A of the town law and the provisions of this act. To the extent that the provisions of this act shall in any way be in conflict with articles 12 and 12-A of the town law, the provisions of this act shall be controlling. S 2. The purpose of the road improvement district shall be to provide for the repair, reconstruction and maintenance of roads and related appurtenances within and around the Adelaar development area to ensure certain upgrades, improvements and repairs are made pursuant to certain development criteria established by the town of Thompson. Any such development criteria, construction or reconstruction and subsequent maintenance thereof shall be subject to and in accordance with applica- ble provisions of the highway law, procedures established by the New York state department of transportation and the consents of the New York state department of transportation, where applicable.
