Relates to alienation and substitution of certain parklands in the town of Naples in the county of Ontario; allows the town to discontinue as parkland and alienate the lands known as the "James P. Long Memorial Park" so long as the proceeds from the sale are used to further develop and improve existing parks, and dedicate a portion of the Naples Community Park to James P. Long.

TITLE OF BILL:

An act in relation to the alienation and substitution of certain park-
lands in the town of Naples in the county of Ontario

PURPOSE:

This bill would allow the town of Naples to alienate and sell the lands
known as the James P. Long Memorial Park, while using the proceeds to
further develop the Naples Community Park.

SUMMARY OF PROVISIONS:

Section 1: Authorizes the town of Naples Town board to discontinue as
parklands and alienate the lands known as the "James P. Long Memorial
Park"

Section 2: Dedicates the proceeds from the sale of such parkland to
further develop and improve existing park lands and dedicates a portion
of the Naples Community Park to James P Long.

Section 3: Discontinues this land as parklands

Section 4: Enables the town of Naples to dedicate the difference of the

fair market value of the lands to be alienated and the lands to be
developed for the acquisition of additional parklands

Section 5: Requires the town of Naples to comply with any federal
requirements pertaining to the alienation of such parkland prior to the
town allowing alienation.

Section 6: Sets the effective date

JUSTIFICATION:

In 1990, the Town of Naples acquired a much larger area of land in the
north end of town, about 90 acres. This land is now named the Naples
Community Park, and has been developing soccer, baseball and softballs
fields, as well as picnic pavilions, a running track, hiking trails,
etc.

By selling the current land known as the James P. Long Memorial Park,
the town can use the proceeds to further develop the newly acquired
land.

The town of Naples has requested this legislation.

AN ACT in relation to the alienation and substitution of  certain  park-
  lands in the town of Naples in the county of Ontario

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subject to the provisions of this act, the town of  Naples,
in the county of Ontario, acting by and through its town board, is here-
by  authorized  to discontinue as parklands and alienate the lands known
as the "James P. Long Memorial Park" further described in section  three
of this act.
  S 2. The authorization contained in section one of this act shall take
effect  only  upon  the condition that the town of Naples shall dedicate
the proceeds from the sale of  such  parkland  to  further  develop  and
improve  existing parklands, and dedicate a portion of the Naples Commu-
nity Park to James P. Long.
  S 3. The lands authorized by section one of this act to be  discontin-
ued as parklands are as follows:
All  THAT  TRACT OR PARCEL OF LAND situate in the Town of Naples, County
of Ontario and State of New York, bounded and described as follows:
BEING a parcel of land located on the southeast  side  of  N.Y.S.  Rtes.
#21  and  #245,  commencing  at  a point in the east line of said N.Y.S.
Rtes. #21 and #245 distant south-southwesterly 800 feet from  the  south
line  of  lands  now  owned  by one Northrop (formerly Wallace Fleming);
thence south-southwesterly and continuing along the east  line  of  said
N.Y.S.  Rtes.  #21  and  #245  to  the  north line of lands now owned by
Charles H. Warren and Anna A. Warren, his wife;  thence  easterly  along
the north line of said Warren lands a distance of approximately 370 feet
to  the  west  line  of lands now owned by August Schoenthaler and Freda
Schoenthaler, his wife; thence north-northeasterly along the  west  line
of  said  Schoenthaler  a distance of approximately 490 feet to a point;

 EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                      [ ] is old law to be omitted.

thence westerly and parallel with the south line of  the  said  Northrop
lands  a  distance  of  approximately  350 feet to the east line of said
N.Y.S. Rtes. #21 and #245 and the point and place of beginning, contain-
ing approximately 4.75 ACRES OF LAND.
  S  4.  In the event that the parklands to be developed and improved by
the town of Naples pursuant to this act are not equal to or greater than
the fair market value of the parkland to be discontinued,  the  town  of
Naples  shall  dedicate  the  difference of the fair market value of the
lands to be alienated and the lands to be developed for the  acquisition
of additional parklands and/or for capital improvements to existing park
and recreational facilities.
  S 5. In the event that the town of Naples received any funding support
or  assistance from the federal government for the purchase, maintenance
or improvement of the parklands set forth in section three of this  act,
the  discontinuance  and  alienation  of such parkland authorized by the
provisions of section three of this act shall not occur until  the  town
of  Naples  has complied with any federal requirements pertaining to the
alienation or conversion of such  parklands,  including  satisfying  the
secretary  of  the  interior  that the alienation or conversion complies
with all conditions which the secretary of the interior deems  necessary
to  assure  the  substitution of other lands shall be equivalent in fair
market value and usefulness to the lands being alienated or converted.
  S 6. This act shall take effect immediately.

AN  ACT  in relation to the alienation and substitution of certain park-
  lands in the town of Naples in the county of Ontario

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Subject to the provisions of this act, the town of Naples,
in the county of Ontario, acting by and through its town board, is here-
by authorized to discontinue as parklands and alienate the  lands  known
as  the  "James  P.  Long  Memorial Park" more particularly described in
section three of this act and to sell and convey such parklands at  fair
market  value  and upon such other terms and conditions as determined by
the town board.
  S 2. The authorization contained in section one of this act shall take
effect only upon the condition that the town of Naples shall dedicate an
amount equal to or greater than the fair market value  of  the  property
being  alienated  in this act toward the acquisition of additional park-
land and or capital improvements  to  existing  parkland.  The  town  of
Naples  shall  also  dedicate  a portion of the Naples Community Park to
James P. Long.
  S 3. The parklands authorized by section one of this act to be discon-
tinued as parklands are as follows:
