BILL NUMBER:S5651 TITLE OF BILL: An act to amend chapter 422 of the laws of 2008, relating to creating a public library district in the city of Troy, in the county of Rensselaer, in relation to the public library's finances PURPOSE OR GENERAL IDEA OF BILL: To provide that the annual appropriation made by the city of Troy to the Troy Public Library shall be the whole dollar amount approved by the voters and paid in full to the Troy Public Library. SUMMARY OF SPECIFIC PROVISIONS: Section 1 amends subdivision one of section 4 of chapter 422 of the laws of 2008 related to creating a public library and the tax levy supporting it. Section 2 provide the effective date. JUSTIFICATION: In 2008, legislation was enacted enabling the creation of a special library district in the city of Troy. In 2009, the city of Troy voted to approve the creation of the Troy Public Library with an initial tax levy to support its operations. The city of Troy is required by law to collect the tax to support the operations of the Troy Public Library. The law also provides that funds approved for library purposes shall be considered an annual appropriation. This

McDONALD -- read once and referred to the Committee on Libraries and Education Technology AN ACT to amend chapter 422 of the laws of 2008, relating to creating a public library district in the city of Troy, in the county of Rensse- laer, in relation to the public library's finances THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 4 of chapter 422 of the laws of 2008, relating to creating a public library district in the city of Troy, in the county of Rensselaer, as amended by chapter 321 of the laws of 2009, is amended to read as follows: 1. The initial budget for the public library district shall be deter- mined by a vote of the voters of the district in the initial election as hereinafter provided for. All future budgets that increase or decrease THE DISTRICT'S PROPOSED TAX LEVY AS COMPARED TO THE TAX LEVY IN THE PRECEDING FISCAL YEAR'S BUDGET AND the public library proposed total operating expenditures over the total operating expenditures in the last preceding fiscal year's budget shall be submitted to the residents voting at the annual election of trustees pursuant to section two of this act. Funds voted for library purposes at the initial election and at all future budget elections shall be considered an annual appropri- ation therefor and shall be levied and collected yearly in the same manner and at the same time as other taxes in the city of Troy, AND SHALL BE PAID OVER IN FULL TO THE PUBLIC LIBRARY DISTRICT, WITH NO LESS THAN HALF OF THE AMOUNT OF THE TAX LEVY TO BE PAID BEFORE THE FIRST DAY OF MARCH AND THE FULL BALANCE OF THE AMOUNT OF THE TAX LEVY PAID BEFORE THE FIRST DAY OF SEPTEMBER.
