BILL NUMBER:S5753 TITLE OF BILL: An act to authorize the Mattituck park district, in the town of Southold, county of Suffolk, to discontinue use of certain lands as parklands and sell such lands, and to use proceeds for capital improvements to existing park facilities in the Mattituck park district PURPOSE: To allow the Mattituck Park District to convey a .668 acre parcel of land in the Town of Southold and direct that the proceeds be used for capital improvements to existing park facilities. SUMMARY OF PROVISIONS: The bill provides the authority for the Mattituck Park District, Town of Southampton, County of Suffolk, to convey property for fair market value with the funds obtained from the sale to be used for capital improvements for the existing park facilities. The bill provides a metes and bounds description of the property to be sold. JUSTIFICATION: The Mattituck Park District was created by special act (Chapter 61 of the Laws of 1924) and continued by Chapter 924 of the Laws of 1941 Among the holdings of the District is a parcel less than an acre in size (.668 acre) on Pike Street in Mattituck acquired in 1948. The property is in the business district and is not contiguous to any other park properties. The property has always been used as a parking lot in the community and the District has maintained and borne

The Mattituck park district, in the town of Southold, coun- ty of Suffolk, is hereby authorized to discontinue use of certain park- lands on Pike Street in Mattituck, New York more particularly described in section three of this act, and sell and convey in fee simple for its fair market value and upon such terms and conditions as it deems appro- priate such lands which are no longer useful for park and recreation purposes. S 2. The authorization provided for in section one of this act shall be subject to the requirement that upon the alienation of the lands more particularly described in section three of this act, the Mattituck park district shall dedicate all proceeds from the sale of such lands for capital improvements to existing park facilities in the Mattituck park district. S 3. The lands authorized by section one of this act to be discontin- ued as parklands, and to be sold and conveyed are as follows: ALL that certain plot, piece or parcel of land, situate, lying and being at Mattituck, in the Town of Southold, County of Suffolk and State of New York, being bounded and described as follows: EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. S 2. The authorization contained in section one of this act shall take effect only upon the condition that the Mattituck park district dedicate an amount equal to or greater than the fair market value of the property being alienated in section three of this act toward acquisition of additional parkland and/or capital improvements to existing parkland within the district.
