BILL NUMBER: S6723 TITLE OF BILL : An act authorizing MiYaD to receive retroactive real property tax exempt status PURPOSE : This bill would authorize the County of Nassau to accept an application for exemption from real property taxes submitted by MiYaD. SUMMARY OF PROVISIONS : Section 1 authorizes the town of Oyster Bay to accept an application for exemption for real property taxes from MiYaD to be reviewed as if it had been received on or before the taxable status date. JUSTIFICATION : MiYaD is a registered religious non-profit with Nassau County Clerk's Office in New York State and a registered tax-exempt 501(c)3 organization. In July 2013, MiYaD purchased a residence at 82 Forsythia Lane in Jericho to function as a venue for Jewish ritual observances, including Shabbos and Jewish holiday programs.

MARCELLINO -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT authorizing MiYaD to receive retroactive real property tax exempt status THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law to the contrary, the assessor of the county of Nassau is hereby authorized to accept from MiYaD an application for exemption for real property taxes pursuant to section 420-a of the real property tax law for the 2013-2014 assessment roll, for the parcel conveyed to such organization, with such parcel being located in the hamlet of Jericho at 82 Forsythia Lane, otherwise known as Nassau county tax map section 12, block 577, lot 35. If accepted, the application shall be reviewed as if it had been received on or before the taxable status date established for such roll. If satisfied that such organization would otherwise be entitled to such exemption if such organization had filed an application for exemption by the appropriate taxable status date, such assessor, upon approval by the Nassau county legislature, may make appropriate correction to the subject roll. If such exemption is granted the appli- cable governing body or tax department may, in its sole discretion, provide for the refund of those taxes paid and cancel those taxes, fines, penalties, liens, or interest remaining unpaid.
