TITLE OF BILL:  An act to amend the general municipal law, in relation
to authorizing the lease of space on certain sports field fences in the
town of New Castle, in the county of Westchester

 
PURPOSE:

Authorizes the town of New Castle, Westchester County, to allow the
lease of space on the fences at Gedney Park, Millwood Park and the
Recreation Field annually to a not for profit corporation or organiza-
tion, with the revenue used for the sole purpose of the care of said
parks.

 
SUMMARY OF PROVISIONS:

Section one of the bill allows the town of New Castle to lease any and
all sports field fences at Gedney Park, Millwood Park and the Recreation
Field annually, at a nominal rent, to a not-for-profit corporation or
organization, organized under the laws of the State of New York for the

purpose of permitting the sale of advertising, with the revenues to be
used solely for the care of said parks in the town of New Castle, West-
chester county. Section two contains the effective date.

 
JUSTIFICATION:

The town of New Castle has requested legislation to allow the leasing of
space on sports field fences in certain town parks. The Town believes
that providing advertising and/or sponsorship space on sports field
fences at Town parks would produce additional revenues that could be
used for maintaining the town's parks and supporting recreational activ-
ities and programming therein.  The Town will administer such leasing
activity through and with the assistance of a not-for-profit corpo-
ration.

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  general  municipal  law  is  amended by adding a new
 section 77-h to read as follows:
   § 77-H. SPORTS FIELD FENCE LEASES IN THE TOWN OF NEW CASTLE.  NOTWITH-
 STANDING ANY PROVISION OF ANY LAW OR OF ANY CHARTER TO THE CONTRARY, THE
 TOWN OF NEW CASTLE, IN THE COUNTY OF WESTCHESTER, IS AUTHORIZED TO LEASE
 ANY AND ALL SPORTS FIELD FENCES AT GEDNEY PARK, MILLWOOD  PARK  AND  THE
 RECREATION  FIELD  WITHIN  SUCH  TOWN  ANNUALLY, AT A NOMINAL RENT, TO A
 NOT-FOR-PROFIT CORPORATION OR ORGANIZATION, ORGANIZED UNDER THE LAWS  OF
 THE  STATE  FOR  THE PURPOSE OF PERMITTING THE SALE OF ADVERTISING, WITH
 THE REVENUES THEREFROM TO BE USED SOLELY FOR THE CARE OF SUCH PARKS  AND
 FIELD.
