S T A T E O F N E W Y O R K ________________________________________________________________________ 6429 2021-2022 Regular Sessions I N A S S E M B L Y March 17, 2021 ___________ Introduced by M. of A. HYNDMAN -- read once and referred to the Commit- tee on Health AN ACT to amend the public health law, in relation to requiring hospi- tals distribute literature created by the commissioner to patients at a high risk of sickle cell disease THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 2803-z to read as follows: § 2803-Z. SICKLE CELL DISEASE INFORMATION DISTRIBUTION. THE COMMIS- SIONER SHALL DESIGN AN INFORMATIONAL PACKET ABOUT SICKLE CELL DISEASE, INCLUDING SCREENING, PREVENTION, AND TREATMENT INFORMATION. EVERY GENER- AL HOSPITAL SHALL DISTRIBUTE THE PACKET TO EVERY PATIENT, OR, IF THE PATIENT LACKS CAPACITY TO MAKE HEALTH CARE DECISIONS, TO A PERSON WHO HAS AUTHORITY TO MAKE HEALTH CARE DECISIONS FOR THE PATIENT WHO IS SUSPECTED TO BE AT HIGH RISK OF INHERITING SICKLE CELL DISEASE. § 2. Subdivision 1 of section 207 of the public health law is amended by adding a new paragraph (p) to read as follows: (P) SICKLE CELL DISEASE INCLUDING BUT NOT LIMITED TO SCREENING, PREVENTION, AND TREATMENT INFORMATION. THE PROGRAM SHALL INCLUDE AN ADVISORY COUNCIL UNDER THIS SECTION THAT SHALL INCLUDE PATIENTS WITH SICKLE CELL DISEASE AND THEIR FAMILIES AND HEALTH CARE PROVIDERS SPECIALIZING IN TREATING SICKLE CELL DISEASE, AMONG OTHERS. § 3. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD08518-02-1
