S T A T E O F N E W Y O R K ________________________________________________________________________ 8418 2021-2022 Regular Sessions I N A S S E M B L Y November 8, 2021 ___________ Introduced by M. of A. CRUZ -- read once and referred to the Committee on Energy AN ACT to require the public service commission to develop recommenda- tions regarding the establishment of microgrids THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding the provisions of any general, special or local law to the contrary, the public service commission, in consulta- tion with the division of homeland security and emergency services, shall develop recommendations regarding the establishment of microgrids in the state of New York. For purposes of this act, the term "microgrid" shall mean a group of interconnected loads and distributed energy resources within clearly defined electrical boundaries that acts as a single controllable entity with respect to the grid and can connect and disconnect from the grid to enable it to operate in both grid-connected or island-mode. Specifically, the commission shall develop recommenda- tions which include, but are not limited to, the following: (a) Whether microgrids should be established at hospitals, first responder headquarters, such as police and fire stations, emergency shelters, schools, water filtration plants, sewage treatment plants and other locations in the state of New York; (b) The geographic areas in the state of New York where the establish- ment of such microgrids should be a priority, based upon severe storm damage during the two years prior to the effective date of this act; and (c) Funding mechanisms that should be considered in order to pay for the establishment of such microgrids. § 2. The commission shall submit a final report of recommendations to the governor, the temporary president of the senate and the speaker of the assembly within one year after the effective date of this act. § 3. The New York state energy research and development author- ity, in consultation with the department of public service and the divi- sion of homeland security and emergency services, shall prepare a report including recommendations regarding the establishment of microgrids for protection of critical facilities in the state of New York. For purposes of this act, the term "microgrid" shall mean a group of interconnected loads and distributed energy resources within clearly defined electrical boundaries that acts as a single controllable entity with respect to the grid and can connect and disconnect from the grid to enable it to oper- ate in both grid-connected or island-mode. Specifically, the authority shall develop recommendations which include, but are not limited to, the following: (a) Whether microgrids should be established at hospitals, first responder headquarters, such as police and fire stations, emergency shelters, schools, water filtration plants, sewage treatment plants and other critical facilities in the state of New York; (b) The geographic areas in the state of New York where the establish- ment of microgrids should be a priority, based upon prior severe storm damage and the consideration of disadvantaged communities as defined in EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
