 AN ACT to amend the racing, pari-mutuel wagering and  breeding  law,  in
   relation  to  the  membership of the board of directors of the western
   regional off-track betting corporation
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  racing,  pari-mutuel  wagering  and  breeding law is
 amended by adding a new section 502-a to read as follows:
   § 502-A. SPECIAL PROVISIONS WITH REGARD TO THE WESTERN  REGIONAL  OFF-
 TRACK BETTING CORPORATION. NOTWITHSTANDING ANY INCONSISTENT PROVISION OF
 THIS  ARTICLE,  ON  THE  EFFECTIVE DATE OF THIS SECTION THE TERM OF EACH
 BOARD MEMBER OF THE WESTERN REGIONAL OFF-TRACK BETTING  CORPORATION,  OR
 ANY VACANT POSITION, SHALL BE DEEMED EXPIRED, AND EACH SUCH BOARD MEMBER
 OR  VACANT  POSITION  SHALL  BE  REPLACED WITH THE NEW APPOINTMENTS MADE
 PURSUANT TO THIS SECTION.  THE  WESTERN  OFF-TRACK  BETTING  CORPORATION
 BOARD  OF DIRECTORS SHALL BE COMPOSED OF FIFTEEN MEMBERS TO BE APPOINTED
 AS FOLLOWS: THREE MEMBERS TO REPRESENT THE COUNTIES OF MONROE,  WYOMING,
 AND ORLEANS; ONE MEMBER TO REPRESENT THE COUNTIES OF CHAUTAUQUA, CAYUGA,
 GENESEE,  LIVINGSTON,  SCHUYLER,  AND  SENECA; FOUR MEMBERS TO REPRESENT
 ERIE COUNTY; ONE MEMBER TO  REPRESENT  NIAGARA  COUNTY;  ONE  MEMBER  TO
 REPRESENT  THE COUNTIES OF OSWEGO, CATTARAUGUS, AND WAYNE; ONE MEMBER TO
 REPRESENT THE CITY OF BUFFALO; ONE  MEMBER  TO  REPRESENT  THE  CITY  OF
 ROCHESTER; ONE MEMBER APPOINTED BY THE GOVERNOR; ONE MEMBER APPOINTED BY
 THE  TEMPORARY  PRESIDENT OF THE SENATE; AND ONE MEMBER APPOINTED BY THE
 SPEAKER OF THE ASSEMBLY. IN THE CASE OF COUNTIES MAKING  JOINT  APPOINT-
 MENTS, SUCH COUNTIES SHALL COLLABORATE TO SELECT BOARD MEMBERS AND SHALL
 APPOINT  SUCH MEMBERS THROUGH JOINT RESOLUTIONS PASSED BY SUCH COUNTIES'
 COUNTY LEGISLATURE OR BOARD OF SUPERVISORS.
   § 2. This act shall take effect on the one hundred twentieth day after
 it shall have become a law, provided, however, that effective immediate-
 ly municipalities may take any action necessary to begin  the  selection
 and appointment process for new board member terms pursuant to this act.
