Report Of The New York State Senate Select Committee To Investigate The Facts And Circumstances Surrounding The Conviction Of Hiram Monserrate

In October 2009, the New York State Senate unanimously passed a resolution approving a special committee of inquiry to investigate the conduct for which Senator Hiram Monserrate was convicted by the State Supreme Court of Queens County. The Committee examined precedent, rules, and all relevant law to establish the proper procedures and identify the remedies available to the Senate. The Committee conducted a thorough review of the facts and relevant evidence, as well as the potential options available under applicable law to address to this matter.

Background Memorandum on Passage of Bills Passed by the New York State Senate on June 30th, 2009

On June 30, 2009, the New York State Senate convened a regular session at noon. Lisa Copeland, Deputy Journal Clerk of the Senate, identified 31 Democratic members as present in the Senate Chamber, along with Senator Frank Padavan (R-Queens). A quorum being obtained, the Senate proceeded to unanimously pass over 100 critical bills.

Paterson v. Adams, et. al. - Petitioner's Materials 6.29.09

Governor Paterson's lawsuit against all 62 members of the Senate was heard by Justice Joseph Teresi on Monday, June 29, 2009.  The judge issued an order requiring all members of the Senate "to convene into session as one group consistent with the Senate Rules on June 30, 2009 at 10:00 AM.

Paterson v. Adams, et. al. - Petitioner's Materials

On Friday, June 26, Governor Paterson sued all 62 Senators, asking Justice Joseph Teresi to issue a writ of mandamus ordering the Senate to convene with a quorum for extraordinary session.  The case is returnable on Monday, June 29 at 4PM.  A copy of petitioner's papers are available below.

Winner and Flanagan v Aponte - Reply Papers by Plaintiff

On June 24, 2009, Senators George Winner and John Flanagan filed a lawsuit against Angelo Aponte regarding his administrative duties as Secretary of the Senate. 

On Friday, June 26, 2009 the matter was adjourned by Justice McNamara until Monday, June 29, to allow further talks among Senators.  A copy of reply papers filed by plaintiffs is available below.
