New York’s eminent domain laws are in need of reform. The Empire State Development Corporation’s attempted taking of private property on behalf of Columbia University illustrates how the current process lacks accountability, transparency or meaningful public participation.

Perkins Holds Eminent Domain Hearing

On December 17, 2009 the New York Amsterdam News reported that Senator Bill Perkins applauded the appellate court decision that rejected the use of eminent domain in regard to the Columbia University’s west side expansion plans.  Additionally, Senator Perkins sent a letter to Governor David Paterson requesting that he place a moratorium on eminent domain, pending legislative action, and not to appeal the court’s decision.

Senate Committe on Corporations, Authorites and Commissions Chairman Bill Perkins' and Assembly Committe on Corporations, Authorites and Commissions Chairman Richard Brodsky's leadership in negotiations with Governor Paterson may lead to sweeping reforms of New York State's over 700 public authorities.
