NY Daily News: State Senate passes $500 fine for subway farebeaters

The MTA could jack up the fine for farebeating from $100 to $500 under legislation the state Senate passed Monday.

The bill — inspired by a Daily News article — would deter riders from jumping turnstiles or entering through emergency exit gates, Sen. Charles Fuschillo (R-L.I.), who drafted the legislation, said.

"The MTA and its fare-paying riders shouldn't have to spend tens of millions of dollars more each year paying for other people’s illegal free rides," Fuschillo, chairman of the Senate's transportation committee, said.

Fare beaters might want to think about investing in a monthly MetroCard.

The state Senate yesterday voted to raise the maximum penalty for subway scofflaws to $500 a summons — five times the highest fine currently on the books. The legislation also raises fines on turnstile jumpers from $50 to $100.

“At a time when every dollar counts, the MTA needs stronger tools to discourage fare evasion,” said Sen. Charles Fuschillo (R-LI), the Transportation Committee chairman and sponsor of the bill.

An Assembly version of the bill must pass and be signed by Gov. Cuomo before the higher fines become law.

Newsday: Under bill, wrong-way DWI would be felony

ALBANY -- Driving the wrong way on a public highway while drunk or impaired would be a felony under a bill that unanimously passed the Senate Monday. The legislation would create a new crime called aggravated reckless driving, a class E felony punishable by up to four years in prison.

The bill's sponsor, Sen. Charles Fuschillo, Jr. (R-Merrick), said there were more than 20 "wrong-way tragedies" on the Island last year.

"It has to stop," he said. The legislation is intended as a deterrent and to "punish those that put lives at risk," he said.

SENATE PASSES FUSCHILLO LEGISLATION TO REQUIRE BACKGROUND CHECKS FOR ALL BUS DRIVERS

Senator Charles J. Fuschillo, Jr. (R-Merrick) today announced that the New York State Senate has passed legislation he sponsors to require all bus drivers to submit to a criminal history check. The legislation would help prevent bus drivers from using aliases to hide from their criminal histories when applying for a driver’s license.

SENATOR FUSCHILLO’S LEGISLATION TO RAISE FINES FOR SUBWAY FARE-BEATERS PASSED BY SENATE

Senator Charles J. Fuschillo, Jr. (R-Merrick) today announced that the New York State Senate has passed legislation he sponsors to raise the fines for those who attempt to avoid paying fares on New York City subways.

The legislation would allow the MTA to raise the current maximum fine for fare-evasion which is so low that it is often cheaper than paying the fare itself.

Senator Charles J. Fuschillo, Jr. (R-Merrick) announced today that the New York State Senate has passed legislation he sponsors to create felony charges for wrong-way and other reckless drivers.

“Wrong-way drivers have caused tragedies and endangered lives on our roadways; it has to stop. Creating felony charges for wrong-way and reckless drivers will give law enforcement another tool to prosecute these individuals and get them off the roads,” said Senator Fuschillo, Chairman of the Senate’s Transportation Committee.

SENATE TRANSPORTATION COMMITTEE APPROVES LEGISLATION TO PROTECT SCHOOL CHILDREN

Senator Charles J. Fuschillo, Jr. (R-Merrick), Chairman of the Senate’s Transportation Committee, today announced that the Senate’s Transportation Committee has approved legislation that would better protect school children while riding on buses.

“Individuals who have criminally endangered children’s safety should not be given the responsibility of protecting children on a school bus. Keeping these individuals from getting behind the wheel of a school bus, as well as raising penalties for people who repeatedly pass stopped school buses illegally, is a common sense step to protect children from harm,” said Senator Fuschillo.

State Senator Charles J. Fuschillo, Jr. (R-Merrick) and Assemblyman David McDonough (R-North Merrick) recently joined with the Wantagh Football Club to honor one of the organization’s outstanding young athletes at its annual awards luncheon.

Thirteen year old Jimmy Errante was awarded the Wantagh Football Club’s Senator Fuschillo Award, which is given to a football player who has been in the program from his first day of eligibility and who serves as a role model and leader for his fellow athletes both on and off the field.

SENATOR FUSCHILLO, SENATOR MARTINS, AND SENATOR ZELDIN: EXECUTIVE BUDGET FALLS SHORT ON EDUCATION FUNDING FOR LONG ISLAND

        Senator Charles J. Fuschillo, Jr. (R-Merrick), Senator Jack Martins (R-Mineola), and Senator Lee Zeldin (R-Shirley) today stated that the recent proposed executive budget which calls for a 4% increase in state aid to education does not provide Long Island schools with their fair share.

        In the recently announced executive budget, Nassau and Suffolk Counties receive a disproportionate share of state education aid. Long Island is home to approximately 17 percent of the state’s students. However, out of the over $19.7 billion in state education aid appropriated for school districts statewide under the executive budget, aid to Long Island falls short.

SENATOR FUSCHILLO BILL TO CLOSE DUI LEGAL LOOPHOLE PASSED BY SENATE

        Senator Charles J. Fuschillo, Jr. (R-Merrick) today announced that the Senate has approved legislation he sponsored to close a legal loophole which allows some intoxicated drivers to escape prosecution for DUI.

        Current law contains a loophole in which individuals can be charged with a DUI offense only if they are intoxicated or impaired by alcohol or by one of the drugs listed in the public health law. Those who ingest substances not listed in the law (such as inhaling an aerosol can) can escape being charged with DUI.

SENATE TRANSPORTATION COMMITTEE APPROVES ANTI-DWI LEGISLATION

Senator Charles J. Fuschillo, Jr. (R-Merrick), Chairman of the Senate’s Transportation Committee, today announced that the committee has approved several measures to help strengthen the state’s DWI laws.

Senator Fuschillo, who sponsored the anti-DWI measures, said “Drunk drivers endanger innocent lives every time they choose to get behind the wheel. Giving law enforcement greater tools to catch and prosecute drunk drivers will help make our roads safer for everyone.”

The anti-DWI legislation approved by the committee would:

SENATOR FUSCHILLO RECEIVES AUTISM ADVOCACY AWARD FROM AUTISM SPEAKS

Senator Charles J. Fuschillo, Jr. (R-Merrick) was recently honored by Autism Speaks for his tireless advocacy for individuals with autism.

Senator Fuschillo received Autism Speaks’ Autism Advocacy Award for authoring New York State’s autism insurance reform law. The law will enable individuals with autism spectrum disorders to receive insurance coverage for screening, diagnosis and treatment. The law will save families with autism tens of thousands of dollars a year in out of pocket costs for autism treatment and therapies which many insurance companies refuse to cover. The law takes effect on November 1st.

SENATOR FUSCHILLO CALLS ON WASHINGTON TO FULLY RESTORE TAX BENEFIT FOR COMMUTERS

With Congress returning to Washington for session today, Senator Charles J. Fuschillo, Jr. (R-Merrick), Chairman of the New York State Senate’s Transportation Committee, once again wrote to Congressional leaders urging them to fully restore the federal commuter mass-transit tax benefit.

Congress allowed the benefit, which helps residents offset their commuting expenses, to be cut nearly in half on January 1st. As a result, commuters are now facing hundreds of dollars in higher costs.

Newsday: Lawmakers aim to restore commuter tax break

Lawmakers at the state and federal levels say they are fighting to restore a recently expired tax break for commuters that previously saved transit users on Long Island hundreds of dollars a year.

State Sen. Charles Fuschillo (R-Merrick) earlier this month introduced a bill to allow commuters in the state to deduct up to $240 in transit costs from their state taxes -- a move meant to ease the hurt caused when a federal tax benefit for commuters expired Dec. 31.

"The residents of Long Island rely heavily on the Long Island Rail Road," Fuschillo said. "They should not be penalized because Congress can't get their act together."
