Buffalo News: New York Bill Aims to Protect Interns Against Sexual Harassment

Sen. Krueger today announced her introduction of legislation to protect unpaid interns from sexual harassment and workplace discrimination. The Buffalo News' Tom Precious reports:

Days after a federal judge said an unpaid intern did not have the same protections as paid employees against workplace sexual harassment, a state lawmaker has introduced legislation to end what has been described as a dangerous loophole in the state’s human rights laws. Sen. Liz Krueger, a Manhattan Democrat, wants to end sexual harassment episodes in which employers have escaped without penalty solely because the victim was an intern.

Sen. Krueger, Assemblywoman Jaffee, Advocates Announce Legislation to Prevent Employer Discrimination Against Women for Reproductive Health Decisions

Today Senator Krueger and Assemblymember Ellen Jaffee (D-Suffern) unveiled legislation banning employers from discriminating against employees on the basis of their personal reproductive health decisions (S. 6578A / A. 8769). Known to advocates and legislators as the “Boss Bill,” this legislation would close a glaring loophole in New York’s existing workplace anti-discrimination laws.

Ms. Magazine: New York Legislators Introduce Bill Banning Employer Discrimination Against Women For Reproductive Health Decisions

Ms. Magazine writes of Sen. Krueger's "Boss Bill":

The "Boss Bill" would close a loophole in New York's current workplace anti-discrimination laws to ensure women are not discriminated against for their personal reproductive health choices and to protect their privacy. Krueger and Jaffee drafted it in response to the over 100 federal lawsuits by employers trying to avoid the Affordable Care Act's (ACA) contraception mandate, which requires employers to provide coverage for FDA-approved contraceptives, including the pill and IUDs, without co-pays or deductibles.

Sen. Krueger, Advocates Applaud Passage of “Boss Bill” in Senate Labor Committee, Call for Floor Vote Before End of Session

Sen. Krueger applauded the Senate Labor Committee’s passage today of her legislation banning employers from discriminating against employees on the basis of their personal reproductive health decisions (S. 6578B). Sen. Krueger called on the Senate majority’s co-leaders to follow up on this positive step by allowing a floor vote on the bill before the close of the 2014 session.

Krueger Bill to Protect Interns from Sexual Harassment and Discrimination Passes Senate Committee; Sen. Krueger Calls for Floor Vote by End of Session

This morning, Sen. Krueger applauded the Senate Investigations & Government Operations Committee’s passage yesterday of her legislation to ban workplace sexual harassment of unpaid interns in New York State (S. 5951A). Loopholes in local, state, and federal laws have hampered interns’ attempts to seek redress for sexual harassment through the courts. Sen. Krueger called upon Senate majority co-leaders Dean Skelos and Jeff Klein to allow a floor vote on the bill, which will be eligible for a vote as early as next week. Earlier this year, the New York City Council led on this issue by passing local legislation sponsored by Councilmember James Vacca (D-Bronx); Sen. Krueger’s legislation would protect interns in workplaces across the entire state.

“Boss Bill” Passes in Assembly with Bipartisan Support; Krueger and Jaffee Call for Senate Vote Before End of Session

Sen. Krueger applauded the Assembly's passage today of legislation she sponsors with Assemblymember Ellen Jaffee (D-Suffern) banning employers from discriminating against employees on the basis of their personal reproductive health decisions (A. 8769A / S. 6578B). The bill passed 80-22, with eight Republican members supporting the bill, including Jane Corwin (R-Clarence) who spoke in favor of the bill during floor debate. Sen. Krueger and Assemblymember Jaffee called on the Senate majority’s co-leaders to allow a Senate floor vote on the bill before the close of the 2014 session.

Councilmember Laurie Cumbo and Sen. Krueger Answer Hobby Lobby Decision with Rally for Passage of “Boss Bill” to Ban Workplace Discrimination Against Employees on Basis of Healthcare Decisions

Senator Krueger, City Council Member Laurie A. Cumbo, and Public Advocate Letitia James were joined by a diverse group of advocates and fellow elected leaders on the steps of City Hall to call for passage of the “Boss Bill” (A.8769A / S.6578B), which would strengthen current workplace anti-discrimination laws in New York State, protecting employees’ rights to access reproductive healthcare and services free from employer retaliation. The bill, sponsored by Sen. Krueger and Assemblymember Ellen Jaffee, was passed with bipartisan support in the Assembly during the final week of this year’s legislative session, but was not given a vote by the State Senate.
