New York State Senator Rev. Ruben Diaz Introduces Anti-Chokehold Legislation

New York State Senator Reverend Ruben Diaz (D-Bronx) is introducing a Senate Bill to make the use of chokehold illegal in New York State. This bill "establishes the crime of strangulation in the first degree, disregard of banned employment procedures."

Senator Rev. Diaz stated: "Every time I see the video of Eric Garner, or think about Anthony Baez, it breaks my heart. As a State Senator and as a Minister I am obligated to do whatever I can to prevent another person from being a victim of chokehold. I pray that this amendment to the New York State Penal Law will in fact, protect people from this vicious crime."

You should know that when a person is elected to serve and represent the needs of others, the duties of that elected person often include appointing people to serve alongside them. In political reality, there are certain qualities of potential appointees, aside from professional qualifications, that we must consider: race, creed, color, and sex – to name a few.

Another Choke Hold, Another Killing

You should know that on Thursday, July 17, 2014, Staten Island resident and father of six, Eric Garner died as a victim of choke hold by New York City Police officers. Eric Garner was unarmed, except for the loose cigarettes he was accused of selling.

You should already know that on December 22, 1989, Bronx resident Anthony Baez was killed when New York City Police officers used a chokehold on him. Anthony Baez was also unarmed, except for the football he was tossing with his brothers.

You should know that on June 10, 2014, a California judge ruled that teacher tenure laws in California are unconstitutional. Plaintiffs in that lawsuit argued that the rights of students who attend poor and minority schools are violated because their schools are disproportionately staffed by ineffective and bad teachers, and those bad teachers are protected by tenure.

You should know that since New York City Mayor Bill de Blasio and Police Commissioner Bill Bratton eliminated the Stop and Frisk policy, the number of shootings and loss of life by innocent bystanders has increased to the point that if this does not stop soon, New York City might become the next O.K. Corral.

You should know that the O.K. Corral involved the shooting between the Earp brothers, Wyatt, Virgil and Morgan – and the Clanton brothers – in Tombstone, Arizona on October 26, 1881. It is still regarded as the biggest gunfight in the American Old West.

Senator Reverend Ruben Diaz (D-Bronx) and the New York Hispanic Clergy Organization will hold a prayer vigil on Monday, June 30, 2014 at 9AM at the Bronx Hall of Justice located at 265 East 161st Street in the Bronx, where criminal defendant Nanic Aidasani will appear in Court. Criminal charges of second-degree rape have been brought against Mr. Aidasani, a licensed practicing nurse who worked at the Manhattanville Rehabilitation & HealthCare Center in Riverdale. The victim is an elderly woman who suffers from dementia.
