SENATE PASSES BILL TO TOUGHEN LAWS FOR DRIVING UNDER THE INFLUENCE

The New York State Senate today passed legislation that creates new penalties for individuals supervising another driver while also under the influence of drugs or alcohol, also known as Abbagail’s Law (S.164C). The bill, sponsored by Senator George Maziarz (R-C, Newfane), is named after eight-year-old Abbagail Buzard, who died in a car accident caused by an inexperienced driver who was supervised by a parent under the influence of alcohol.

Bill Would, For the First Time, Link Convictions for Operating Different Vehicles While Intoxicated

The New York State Senate today passed “Tiffany’s Law” (S.2860A).  The bill would require all prior convictions of operating a vehicle while intoxicated, whether it be an automobile (DWI), snowmobile (SWI), or all-terrain vehicle, be considered during sentencing of a subsequent Boating While Intoxicated (BWI) conviction. In turn, any person convicted of BWI would have that charge considered during any subsequent DWI, SWI or ATV offense.

3/28/12 - Senator Saland speaks with a State Troooper who was staffing the distracted driving display and simulator set up in the LOB today. The display consists of a car that was involved in a serious accident caused by distracted driving.  The nearly demolished car has been taken around to numerous schools and has been signed by students who have pledged not to text and drive.  A good visual reminder with many proms, graduations and other functions happening in the coming months.

Bill Would Require Offenders to Take a Motor Vehicle Accident Prevention Course

The New York State Senate today passed legislation (S.4740C) that would require certain drivers convicted of drunk driving to take a motor vehicle accident prevention course. The bill requires drivers convicted of a drunk driving offense to take the motor vehicle accident prevention course if they have previously been convicted of drunk driving, or refuse to take a chemical test, or have accumulated more than six points on their license.

SENATE PASSES LEGISLATION TO STRENGTHEN LEANDRA’S LAW

The New York State Senate today passed legislation, to strengthen Leandra’s Law. The legislation would ensure that offenders comply with the provision of the law requiring them to use ignition interlocks.

Leandra’s Law was passed in 2009 following the tragic death of 11 year old Leandra Rosado, who was killed while riding in a car driven by her friend’s intoxicated mother. As part of Leandra’s Law, all convicted DWI offenders must install and use an ignition interlock in all vehicles they own or operate for a period of at least six months after their DWI conviction. Ignition interlocks are breath test devices linked to a vehicle’s ignition system which prevent the car from starting if alcohol is detected in the driver’s breath.
