Judges required to consider victim’s risk factors before determining bail

Senator Steve Saland (R, I, C - Poughkeepsie) today announced that the Senate has passed his legislation to further protect victims of domestic violence by requiring judges to consider certain risk factors to victims when determining bail in domestic violence cases (S.1414A).

SENATE PASSES SEX ABUSE PREVENTION BILLS

Measures Increase Penalties, Enhance Community Notification and Protection

The New York State Senate today passed a package of eight bills to prevent sexual predators from obtaining access to potential victims and help law enforcement and communities keep track of their whereabouts. The bills will help increase the amount of information available about convicted sex offenders and seeks to prevent them from obtaining access to vulnerable individuals.

SENATE PASSES BILL TO PROTECT TEENS FROM SEXUAL PREDATORS AT SCHOOLS

The New York State Senate has passed legislation that would make it a crime for school employees to engage in sexual activity with students, including those who are older than New York’s legal age of consent. The bill (S.6714) addresses inappropriate student-school employee relationships by criminalizing sexual conduct between school employees and full-time students of elementary and secondary schools.

SENATE PASSES BILL TO PROTECT REMAINS OF CRIME VICTIMS

The New York State Senate has passed legislation that would close a loophole in the state health law that gave a Western New York man who killed his wife the sole rights to her remains.

In 2009, Constance Shepherd of Tonawanda was brutally murdered by her husband, Stephen Shepherd. Her family fought to gain control of her remains to ensure a proper funeral and burial. However, under the state Public Health Law Stephen Shepherd had the sole rights to control the disposal of her remains. 

When the husband did finally act, it was to dispose of her body in a way that her family believes was intentionally disrespectful, in violation of the woman's beliefs and a further act of hostility towards her.

SENATOR SALAND’S CYBERBULLYING BILL PASSES THE SENATE

Senator Steve Saland (R,I,C – Poughkeepsie) announced today the passage of legislation which would provide further protections and procedures for students who are bullied or cyberbullied.

This legislation provides school districts with the tools they need to address bullying and cyberbullying to help ensure that the school environment is safe for all students. This comprehensive measure includes within the definitions of bullying and cyberbullying verbal and non-verbal actions, whether on or off school property, which create a risk of substantial disruption of the school environment.

SENATOR STEVE SALAND ANNOUNCES LAW TO EXPAND DNA DATABANK EFFECTIVE TODAY

Senator Steve Saland (R-I-C, Poughkeepsie) announces that the law he sponsored to expand New York State’s DNA Databank becomes effective as of today. The law provides the largest expansion of the state’s DNA databank since it was created in 1994 and represents a joint effort between of the Legislature, the Governor’s Office, and State law enforcement to ensure that New York continues to set the standard in statewide safety.

Closes Reporting Requirements Loophole For Sex Offenses

Senator Stephen Saland (R,I,C - Poughkeepsie) announced today that his bill remedying a significant loophole in reporting requirements for medical professionals has been signed into law by Governor Andrew Cuomo. The legislation, Senate Bill 7456, requires professional conduct officers or investigators of misconduct to report sex offenses committed by mental health professionals to appropriate law enforcement.

Previously, reporting requirements varied according to the license of the offender. Saland said the law will bring consistency to the reporting requirements of similar sex offenses.

Parents of murder victim Katie Sepich, along with Elizabeth Smart, recognize Senator Stephen Saland for his work on SB6733 to require DNA upon conviction of all misdemeanors

CHICAGO, Illinois. (August 8, 2012) - The parents of murder victim Katie Sepich were joined by abduction survivor Elizabeth Smart in presenting New York State Senator Stephen Saland with the “Katie’s Hero Award”. The Katie’s Hero Award is an honor bestowed by the Sepich’s non-profit advocacy group DNA Saves on individuals for leadership in solving and preventing crime by supporting legislation to expand the use of forensic DNA technology. According to the certificate of award, Senator Saland was selected for his strong support of SB6733 in 2012 to require DNA upon conviction of all misdemeanors in New York, to ensure law enforcement is not unwittingly releasing repeat offenders back into the community.
