TITLE OF BILL:

An act to amend the social services law, in relation to making vouchers
available under the family homelessness and eviction prevention supple-
ment program in social services districts with a population of five
million or more

 
PURPOSE:

Relates to the provision of FHEPS housing vouchers in social services
districts with a population of five million or more.

 
SUMMARY OF PROVISIONS:

Section one of the bill amends the social services law by adding a new
section 131-bb to require that for local social services district with a
population of five million or more, the commissioner shall make vouchers
available to eligible families under the family homelessness and

eviction prevention supplement ("FHEPS") program and administer the
program, provided that the maximum rent for such vouchers are set at
fair market rent level, in accordance to the United States Department of
Housing and Urban Development. The state shall reimburse the local
social services districts for payments under the FHEPS program.

Section two establishes the effective date.

 
JUSTIFICATION:

The current maximum rent levels allowed under the state FHEPS program
are limited to 85% of the fair market rent. In New York, this means
low-income families who have experienced eviction, are at risk of
eviction, or are living in shelters are limited in their housing choice
to a sliver of the market, often in low-opportunity communities, if they
can find housing at all. Keeping FHEPS levels below the fair market
rent-which is still not median rent for New York City, but is the 40%
rent rate for the entire metropolitan area-means families remain unshel-
tered because they cannot find housing at such sub-market levels. This
bill would bring the maximum rent for state FHEPS to 100% of the fair
market rent, and will move more families into permanent, stable housing.

 AN ACT to amend the social services law, in relation to making  vouchers
   available  under  the  family  homelessness  and  eviction  prevention
   supplement program in social services districts with a  population  of
   five million or more
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The social services law is amended by adding a new  section
 131-bb to read as follows:
   §  131-BB.  FAMILY  HOMELESSNESS  AND  EVICTION  PREVENTION SUPPLEMENT
 PROGRAM. NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, FOR
 A LOCAL SOCIAL SERVICES DISTRICT WITH A POPULATION OF  FIVE  MILLION  OR
 MORE,  THE  COMMISSIONER  SHALL  DESIGNATE  SUCH  LOCAL  SOCIAL SERVICES
 DISTRICT TO MAKE VOUCHERS AVAILABLE TO ELIGIBLE FAMILIES UNDER THE FAMI-
 LY HOMELESSNESS AND EVICTION PREVENTION  SUPPLEMENT  ("FHEPS")  PROGRAM,
 AND  TO ADMINISTER THE PROGRAM IN ACCORDANCE WITH A PLAN APPROVED PURSU-
 ANT TO 18 N.Y.C.R.R. § 352.3(A)(3), PROVIDED HOWEVER, THAT  THE  MAXIMUM
 RENT  FOR  SUCH VOUCHERS SHALL BE SET AT THE UNITED STATES DEPARTMENT OF
 HOUSING AND URBAN DEVELOPMENT'S FAIR MARKET RENT LEVEL. THE STATE  SHALL
 REIMBURSE THE LOCAL SOCIAL SERVICES DISTRICT FOR PAYMENTS MADE UNDER THE
 FHEPS PROGRAM IN A MANNER CONSISTENT WITH TITLE TWO OF THIS ARTICLE.
   § 2. This act shall take effect immediately.
