JOHN, PHEFFER -- read once and referred to the Committee on Transportation AN ACT to amend the public health law and the vehicle and traffic law, in relation to the biennial examinations of bus drivers employed by a motor carrier THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3703 of the public health law is amended by adding a new subdivision 4 to read as follows: 4. EXAMINATION OF BUS DRIVERS. A REGISTERED PHYSICIAN'S ASSISTANT OR CERTIFIED NURSE PRACTITIONER, ACTING WITHIN HIS OR HER LAWFUL SCOPE OF PRACTICE, MAY CONDUCT EXAMINATIONS AND TESTS UNDER SUBDIVISION ONE OF SECTION FIVE HUNDRED NINE-G OF THE VEHICLE AND TRAFFIC LAW, NOTWITH- STANDING ANY PROVISION TO THE CONTRARY IN SUCH SUBDIVISION. S 2. Subdivision 1 of section 509-g of the vehicle and traffic law, as amended by chapter 600 of the laws of 2002, is amended to read as follows: 1. A biennial examination pursuant to regulations established by the commissioner, by a physician [or], a CERTIFIED nurse practitioner to the extent authorized by law and consistent with the written practice agree- ment pursuant to subdivision three of section six thousand nine hundred two of the education law, OR A REGISTERED PHYSICIAN'S ASSISTANT who is not the personal physician [or], nurse practitioner OR PHYSICIAN'S ASSISTANT of the driver. Included shall be a requirement to conduct a vision test pursuant to regulations issued by the commissioner. S 3. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD02299-01-9

BILL NUMBER:A743A TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to the biennial examinations of bus drivers employed by a motor carrier PURPOSE OR GENERAL IDEA OF BILL: To permit registered physician assist- ants to conduct physical examinations for bus drivers. SUMMARY OF SPECIFIC PROVISIONS: Section 1. Amends subdivision 1 of section 509-g of the vehicle and traffic law, as amended by chapter 600 of the laws of 2002 to include certified nurse practitioners or a regis- tered physician assistant as health care professionals authorized to conduct vision and physical examinations of bus drivers. JUSTIFICATION: Physician assistants are trained to conduct physical examinations. This bill will expand the number of health care practi- tioners available to examine bus drivers.
