BILL NUMBER: S3198 TITLE OF BILL : An act to establish the statewide telemedicine/telehealth task force, and providing for its powers and duties PURPOSE : To provide a framework for the development of telehealth an telemedicine programs. SUMMARY OF SPECIFIC PROVISIONS : This legislation establishes the telehealth/telemedicine task force consisting of sixteen members from government and the health care community. The task force shall make recommendations to the governor and the legislature on the following: * assessment of existing telehealth programs and recommendations for expansion * a plan to develop telemedicine and telehealth systems including: health education, preventive and primary care, specialty diagnostic and clinical services, taking into account access to care by the medically underserved, residents of remote and rural areas, and other special populations

VALESKY -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to establish the statewide telemedicine/telehealth task force, and providing for its powers and duties THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Legislative intent. The legislature recognizes that geography, weather and other factors can create barriers to accessing appropriate health and mental health care in New York State. One way to provide access to care is through the appropriate use of technology to allow health care consumers access to qualified health care providers and institutions. In order to better understand the role of technology in providing access to health care and to ensure that services protect patient confidentiality, the legislature establishes a statewide task force on telemedicine/telehealth. S 2. Statewide telemedicine/telehealth task force. a. There is hereby established within the department of health a statewide telemedicine/telehealth task force, to be comprised of sixteen members who shall be appointed in the following manner: four shall be appointed by the temporary president of the senate and two by the minority leader of the senate; four shall be appointed by the speaker of the assembly and two by the minority leader of the assembly; and four shall be appointed by the governor. The members of the task force shall include representatives of rural hospitals and health systems; community hospi- tals and health systems; academic medical centers; other hospitals and health systems; nursing homes; home health agencies; physicians; nurse practitioners; other health care practitioners; telecommunications or related industries; health care payors; and health care consumers. All appointments shall be made in such a manner to ensure statewide geographic representation. BILL NUMBER:S3198B TITLE OF BILL: An act to amend the public health law, in relation to promoting the development, provision and accessibility of telehealth/telemedicine services in New York state; and to amend the state finance law, in relation to establishing a New York state telehealth/telemedicine devel- opment and research grant fund PURPOSE: This legislation would enact the "New York State telehealth/telemedicine development act" to coordinate and focus state policy and program plan- ning for telehealth and telemedicine. SUMMARY OF SPECIFIC PROVISIONS: This legislation would add a new article 27-M to the public health law, creating the "New York State telehealth/telemedicine act." Section 2799-u establishes a telehealth/telemedicine development program to coordinate and focus state administrative responsibilities and plan- ning efforts relative to telehealth & telemedicine. This would involve the submission of an annual plan to the governor and legislature to include necessary recommendations for legislation, regulatory or budget- ary support; the identification of barriers to the provision of an access to telehealth/telemedicine; an overview of relevant research being conduction.
