 TITLE OF BILL :
An act to amend the environmental conservation law, in relation to the
New York state oil and natural gas advisory board


 PURPOSE OR GENERAL IDEA OF BILL :
This bill seeks to reinvigorate the New York State Oil, Gas and
Solution Mining Advisory Board.

 SUMMARY OF SPECIFIC PROVISIONS :
Amends subdivisions 1 and 2 of section 23-0311 of the Environmental
Conservation Law to:

* Rename the advisory board to the New York State Oil and Natural Gas
Advisory Board;
* Expand membership from thirteen members to fifteen members;
* Provide that the board discuss and provide recommendations on, among
other things, the best practices of the industry, protection of water
supplies and other related topics;
* Provides for appointments from the minority leaders of the Senate
and Assembly;
* Includes the Commissioner of the Department of Agriculture and
Markets as an exofficio member of the board.

 JUSTIFICATION :
Clearly, natural gas exploration and drilling will be on the increase
in New York State in the coming years and we must be sure that there
is an active and engaged group of industry, land owner and municipal
representatives who are discussing and making recommendations to the
Department of Environmental Conservation on needed regulations and
programs.

Given that the current Oil, Gas and Solution Mining Advisory Board has
not met in a number of years, this bill seeks to reinvigorate that
board to provide assistance, discussion and recommendations to the
Department on the development, operation and regulation of the oil and
natural gas industry. The membership of the board is expanded to
facilitate a greater array of viewpoints including at least three
members who are either landowners with a current oil or gas lease or
representatives of a municipality in which there is current oil or gas
exploration and drilling being performed. More than that, the number
of board members is expanded from thirteen members to fifteen members
to provide for appointments from the minority leaders of the Assembly
and Senate.

 PRIOR LEGISLATIVE HISTORY :
New bill.

 FISCAL IMPLICATIONS :
Minimal. Although this bill allows members of the advisory committee
to be reimbursed for mileage for attending meetings and does provide
that the Department of Environmental Conservation provide secretarial
support.

 EFFECTIVE DATE :
Immediately.

AN ACT to amend the environmental conservation law, in relation  to  the
  New York state oil and natural gas advisory board

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The section heading and subdivisions 1  and  2  of  section
23-0311  of  the  environmental conservation law, the section heading as
added by chapter 846 of the laws of 1981 and subdivisions  1  and  2  as
amended  by  chapter  83  of  the  laws  of 1995, are amended to read as
follows:
  New York state oil[,] AND NATURAL gas [and solution  mining]  advisory
board.
  1.  A  [thirteen] FIFTEEN member New York state oil[,] AND NATURAL gas
[and solution mining] advisory board shall be created within the depart-
ment to advise and assist the commissioner and other state  agencies  on
activities  and policies related to the development, operation and regu-
lation of the oil[,] AND NATURAL gas  [and  solution  mining]  industry.
THIS  SHALL  INCLUDE, BUT NOT BE LIMITED TO, DISCUSSIONS AND RECOMMENDA-
TIONS ON THE  BEST  PRACTICES  OF  THE  INDUSTRY,  PROTECTION  OF  WATER
SUPPLIES  AND  RELATED  TOPICS.  The  members  shall be appointed by the
governor, with a majority representative of the  respective  industries,
PROVIDED,  HOWEVER,  THAT  AT  LEAST THREE OF THE MEMBERS ARE EITHER (A)
LANDOWNERS WITH A CURRENT NATURAL GAS OR  OIL  LEASE  OR  (B)  REPRESEN-
TATIVES  OF  A MUNICIPALITY IN WHICH THERE IS CURRENT OIL OR NATURAL GAS
EXPLORATION OR DRILLING BEING PERFORMED.  Three of the members shall  be
appointed upon recommendation of the majority leader of the senate[and],
three  of  the  members  shall  be  appointed upon recommendation of the
speaker of the assembly, ONE MEMBER SHALL BE APPOINTED UPON  RECOMMENDA-
TION  OF  THE  MINORITY  LEADER  OF  THE  SENATE AND ONE MEMBER SHALL BE
APPOINTED UPON RECOMMENDATION OF THE MINORITY LEADER  OF  THE  ASSEMBLY.

 EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

Appointments  shall be made for three-year terms. Members shall continue
in office until their successors have been appointed and qualified.  The
governor  shall  select  a chair from among the members. The board shall
meet  at  least twice yearly and the members shall receive reimbursement
for expenses. The department shall provide the  board  with  secretarial
services.
  2.  The  chair  of the public service commission, the president of the
New York state energy research and development  authority,  THE  COMMIS-
SIONER  OF  THE  DEPARTMENT OF AGRICULTURE AND MARKETS, the state geolo-
gist, and the commissioner shall serve the board in an ex-officio capac-
ity.
  S 2. This act shall take effect immediately.

provides for appointments from the minority leaders of the Senate and
Assembly; Includes the commissioner of the Department of Agriculture
and Markets as an ex-officio member of the board.

SHALL  BE  APPOINTED  UPON  RECOMMENDATION OF THE MINORITY LEADER OF THE
SENATE AND ONE MEMBER SHALL BE  APPOINTED  UPON  RECOMMENDATION  OF  THE
MINORITY  LEADER OF THE ASSEMBLY.  Appointments shall be made for three-
year terms. Members shall continue in office until their successors have
been appointed and qualified. The governor shall  select  a  chair  from
among  the  members.  The board shall meet at least twice yearly and the
members shall receive reimbursement for expenses. The  department  shall
provide the board with secretarial services.
  2.  The  chair  of the public service commission, the president of the
New York state energy research and development  authority,  THE  COMMIS-
SIONER  OF  THE  DEPARTMENT OF AGRICULTURE AND MARKETS, the state geolo-
gist, and the commissioner shall serve the board in an ex-officio capac-
ity.
  2-A. THE BOARD SHALL ISSUE A REPORT, NOT LATER  THAN  DECEMBER  FIRST,
TWO  THOUSAND  ELEVEN, CONTAINING RECOMMENDATIONS ON INDUSTRY BEST PRAC-
TICES AND PROTECTION OF WATER SUPPLIES TO THE  GOVERNOR,  THE  TEMPORARY
PRESIDENT OF THE SENATE, AND THE SPEAKER OF THE ASSEMBLY.

TITLE OF BILL:
An act
to amend the environmental conservation
law, in relation to the New York
state oil, natural gas and solution mining
advisory board

PURPOSE OR GENERAL IDEA OF BILL:
This bill seeks to reinvigorate the New York state oil, Gas and
Solution Mining Advisory Board.

SUMMARY OF SPECIFIC PROVISIONS:
Amends subdivisions 1 and 2 of section 23-0311 of the Environmental
Conservation Law to expand membership from thirteen members to
sixteen members, comprised of two representatives of the oil, natural
gas and solution mining industries, two members representing
landowners with a current natural gas or oil lease, two municipal
officers, as defined in section eight hundred of the general
municipal law, of a municipality in which there is current oil or
natural gas exploration or drilling being performed, two members of
citizens' organizations concerning oil or natural gas exploration or
drilling, three members chosen by the Temporary President of the
Senate, three members chosen by the Speaker of the Assembly, one
member chosen by the Senate minority leader, and one member chosen by

the Assembly minority leader. This bill also provides that the board
shall discuss and make recommendations on, among other things, the
best practices of the industry, protection of water supplies and
other related topics. This bill also includes the commissioner of the
Department of Agriculture and Markets as an ex-officio member of the
board.

JUSTIFICATION:
Clearly, natural gas exploration and drilling will be on the increase
in New York State in the coming years and we must be sure that there
is an active and engaged group of industry, land owner and municipal
representatives who are discussing and making recommendations to the
Department of Environmental conservation on needed regulations and
programs.

Given that the current Oil, Gas and Solution Mining Advisory Board has
not met in a number of years, this bill seeks to reinvigorate that
board to provide assistance, discussion and recommendations to the
Department on the development, operation and regulation of the oil
and natural gas industry. The membership of the board is expanded to
facilitate a greater array of viewpoints. In addition, the number of
board members is expanded from thirteen members to sixteen members
and the bill provides for appointments from the minority leaders of
the Assembly and Senate.

PRIOR LEGISLATIVE HISTORY:
New bill.

FISCAL IMPLICATIONS:
Minimal. Although this bill allows members of the advisory committee
to be reimbursed for mileage for attending meetings and does provide
that the Department of Environmental Conservation provide secretarial
support.

EFFECTIVE DATE:
Immediately.

AN ACT to amend the environmental conservation law, in relation  to  the
  New York state oil, natural gas and solution mining advisory board

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The section heading and subdivisions 1  and  2  of  section
23-0311  of  the  environmental conservation law, the section heading as
added by chapter 846 of the laws of 1981 and subdivisions  1  and  2  as
amended  by chapter 83 of the laws of 1995, are amended and a new subdi-
vision 2-a is added to read as follows:
  New York state oil, NATURAL gas and solution mining advisory board.
  1. A [thirteen] SIXTEEN member New York state  oil,  NATURAL  gas  and
solution mining advisory board shall be created within the department to
advise  and  assist  the commissioner and other state agencies on activ-
ities and policies related to the development, operation and  regulation
of  the  oil,  NATURAL  gas  and  solution  mining  industry. THIS SHALL
INCLUDE, BUT NOT BE LIMITED TO, DISCUSSIONS AND RECOMMENDATIONS  ON  THE
BEST PRACTICES OF THE INDUSTRY, PROTECTION OF WATER SUPPLIES AND RELATED
TOPICS. The members shall be appointed by the governor[, with a majority

representative  of  the respective industries] AND SHALL BE COMPRISED OF
TWO MEMBERS REPRESENTING THE OIL, NATURAL GAS AND SOLUTION MINING INDUS-
TRIES, TWO MEMBERS WHO ARE LANDOWNERS WITH A CURRENT NATURAL GAS OR  OIL
LEASE,  TWO  MEMBERS  WHO  ARE MUNICIPAL OFFICERS, AS DEFINED IN SECTION
EIGHT HUNDRED OF THE GENERAL MUNICIPAL LAW, OF A MUNICIPALITY  IN  WHICH
THERE  IS  CURRENT  OIL  OR  NATURAL  GAS  EXPLORATION OR DRILLING BEING

NATURAL  GAS  EXPLORATION  OR  DRILLING.   Three of the members shall be
appointed upon recommendation of the [majority leader] TEMPORARY  PRESI-
DENT  of  the  senate[and], three of the members shall be appointed upon
recommendation of the speaker of  the  assembly,  ONE  MEMBER  SHALL  BE
APPOINTED  UPON  RECOMMENDATION OF THE MINORITY LEADER OF THE SENATE AND
ONE MEMBER SHALL BE APPOINTED UPON RECOMMENDATION OF THE MINORITY LEADER
