2009-S4490 - Summary
Provides that subscribers of certain policies of health insurance (i.e., individual accident and health insurance policies, group accident and health insurance policies, etc.) shall be entitled to reimbursement for any service which is within the lawful scope of practice of a certified nurse practitioner when said service is performed by a certified nurse practitioner.

BILL NUMBER: S4490 TITLE OF BILL : An act to amend the insurance law, in relation to reimbursement for nurse practitioners PURPOSE OR GENERAL IDEA OF BILL : To provide to subscribers of health insurance policies the right to be reimbursed for services provided to them by certified nurse practitioners working within their lawful scope of practice. SUMMARY OF PROVISIONS : This legislation would ensure reimbursement for subscribers of health insurance policies on the occasions when subscribers receive service from a certified nurse practitioner working within their lawful scope of practice. JUSTIFICATION : Nurse practitioners are authorized to diagnose, treat and refer patients in collaboration with a physician and in accordance with a practice agreement (Education Law Section 6902 (3) (a)). Further, nurse practitioners are authorized to write prescriptions for drugs, devices and immunizing agents (Education Law Section 6902(3) (b)) and nurse practitioners are authorized to dispense drugs (Education Law Section 6807(1)(b)).

DUANE -- read twice and ordered printed, and when printed to be committed to the Committee on Insurance AN ACT to amend the insurance law, in relation to reimbursement for nurse practitioners THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subsection (i) of section 3216 of the insurance law is amended by adding a new paragraph 26 to read as follows: (26) EVERY POLICY WHICH PROVIDES COVERAGE FOR PHYSICIAN SERVICES IN A PHYSICIAN'S OFFICE, AND EVERY POLICY WHICH PROVIDES MAJOR MEDICAL OR SIMILAR COMPREHENSIVE-TYPE COVERAGE SHALL PROVIDE THE SAME COVERAGE FOR SUCH SERVICES WHEN PERFORMED BY A NURSE PRACTITIONER WITHIN THE LAWFUL SCOPE OF HIS OR HER PRACTICE AND CONSISTENT WITH ANY APPLICABLE WRITTEN PRACTICE AGREEMENT, WHO IS CERTIFIED PURSUANT TO ARTICLE ONE HUNDRED THIRTY-NINE OF THE EDUCATION LAW. SUCH COVERAGE MAY BE SUBJECT TO ANNUAL DEDUCTIBLES AND COINSURANCE AS MAY BE DEEMED APPROPRIATE AND AS ARE CONSISTENT WITH OTHER BENEFITS COVERED UNDER THE POLICY. S 2. Subsection (k) of section 3221 of the insurance law is amended by adding a new paragraph 15 to read as follows: (15) EVERY POLICY WHICH PROVIDES COVERAGE FOR PHYSICIAN SERVICES IN A PHYSICIAN'S OFFICE, AND EVERY POLICY WHICH PROVIDES MAJOR MEDICAL OR SIMILAR COMPREHENSIVE-TYPE COVERAGE SHALL PROVIDE THE SAME COVERAGE FOR SUCH SERVICES WHEN PERFORMED BY A NURSE PRACTITIONER WITHIN THE LAWFUL SCOPE OF HIS OR HER PRACTICE AND CONSISTENT WITH ANY APPLICABLE WRITTEN PRACTICE AGREEMENTS, WHO IS CERTIFIED PURSUANT TO ARTICLE ONE HUNDRED THIRTY-NINE OF THE EDUCATION LAW.
