AN ACT in relation to authorizing the Bay Park fire district to refund
and pay a portion of the existing funds in its capital reserve account
to the taxpayers of the district
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Notwithstanding the provisions of any general, special, or
local law to the contrary, including but not limited to any provision
set forth in section 6-g of the general municipal law, the Bay Park fire
district in the town of Hempstead, county of Nassau, is hereby author-
ized to refund and pay to the taxpayers of the district a portion of the
unexpended funds contained in the district's existing capital reserve
fund, as provided in accordance with this act.
S 2. Such refund shall be of an amount to be determined by resolution
of the board of fire commissioners of the district, except that the
total amount of the refund shall not exceed such aggregate sum as would
leave less than $25,000.00 remaining in the fund for use in connection
with future capital expenditures. The board of fire commissioners, by
resolution, may order that the refund be distributed to the taxpayers in
one lump sum, or in equal installments over a period of consecutive
years, not to exceed five years. The refund shall be provided to the
owners of the taxable properties of the district, in proportion to the
assessed valuations of such properties that are in effect during the tax
year in which the refund or any part thereof is provided.
S 3. This authorization shall apply only to funds placed in the
district's capital reserve account prior to the effective date of this
act, and any interest thereon.
S 4. This act shall take effect immediately.
