 TITLE OF BILL :
An act to amend the public service law, in relation to remote net
metering


 PURPOSE :
This legislation expands the scope of the state's net metering law to
allow certain customers of an electric corporation (e.g. NYSEG,
National Grid, etc.) to produce electricity at one location owned or
under the control of the customer and designate another location of
the same customer as the recipient or user of the electricity produced
at the "remote site". Under current law, utilities are required to
provide for the interconnection and net energy metering of wind
generating equipment owned or operated by a "customer-generator".
Customer-generators include three categories:  Residential, Farm
Service and Non-residential. This bill authorizes the Farm Service and
Non-residential categories to avail themselves of the remote net
metering procedure. Farms and school districts in the state are two of
the types of customers that would be able to employ remote metering to
reduce and/or eliminate all or part of an electric bill at one
location and all or part of an electric bill at another location.
Adoption of the legislation will allow customers to save money as they
utilize a renewable energy source to reduce the amount of electricity
they buy from the service providing utility.

 SUMMARY OF PROVISIONS :
The legislation sets forth the procedure for remote metering by
authorizing the designation of net metering credit by a Farm Service
customer or a Non-residential customer of the use of such credit (up
to 100% of the electricity generated at a "remote site") by a separate
location having its own net energy meter and being owned by or under
the control of the Farm Service or Non-residential customer. The bill
contains a requirement that the meter to which the designation of any
net metering credit is made shall be within a radius of25 miles of the
wind electric generating equipment.

 JUSTIFICATION :
Bold and comprehensive energy reform is needed to reach standards set
by New York to reduce our dependence on fossil fuels.  Under this law
farm owners, school districts and others will be able to generate
electricity at one location and via "net-remote metering", obtain
credit for such electricity generation at another location.

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 3 of section 66-1 of the public service law  is
amended by adding a new paragraph (e) to read as follows:

THIS SECTION MAY LOCATE SOLAR  ELECTRIC  GENERATING  EQUIPMENT  OR  FARM
WASTE  ELECTRIC  GENERATING  EQUIPMENT  WITH  A NET ENERGY METER ON LAND
OWNED OR LEASED BY SUCH CUSTOMER-GENERATOR  AND  DESIGNATE  ONE  HUNDRED
PERCENT  OF  THE  NET  METERING CREDITS GENERATED BY SUCH EQUIPMENT TO A
METER OR METERS AT ANY LOCATION OWNED OR LEASED BY SUCH CUSTOMER-GENERA-
