AN  ACT  to  amend  the education law, in relation to authorizing public
  school principals and  chief  administrators  to  enroll  academically
  low-performing students in after-school education programs

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The education law is amended by adding a new section 815 to
read as follows:
  S 815. AUTHORIZATION TO ENROLL UNDER-PERFORMING STUDENTS  IN  ACADEMIC
AFTER-SCHOOL  PROGRAMS. THE PRINCIPAL OR CHIEF ADMINISTRATOR OF EACH NEW
YORK STATE PUBLIC SCHOOL SHALL HAVE THE AUTHORITY TO ENROLL ANY  STUDENT
ATTENDING  SUCH  SCHOOL  AND  PERFORMING BELOW ACADEMIC STANDARDS IN ANY
SUBJECT REQUIRED FOR GRADUATION  IN  AN  AFTER-SCHOOL  PROGRAM  OFFERING
TRAINING  OR  TUTORING IN SUCH SUBJECT. SUCH AFTER-SCHOOL PROGRAM MAY BE
CONDUCTED ON SCHOOL PREMISES OR AT A NEIGHBORING SCHOOL OR OTHER  NEIGH-
BORING   EDUCATIONAL   FACILITIES  THAT  CONDUCT  ACADEMIC  AFTER-SCHOOL
PROGRAMS APPROVED BY THE COMMISSIONER.
  S 2. This act shall take effect immediately.
