AN ACT to amend the  environmental  conservation  law,  in  relation  to
  excluding certain animals from the definition of wildlife

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Paragraph a of subdivision 6  of  section  11-0103  of  the
environmental conservation law, as amended by chapter 777 of the laws of
1976, is amended to read as follows:
  a.  "Wildlife" means wild game and all other animal life existing in a
wild state, except fish, shellfish and crustacea.  NO DOG OR CAT WHETHER
DOMESTICATED OR FERAL, OR ANY OTHER DOMESTICATED ANIMAL  NORMALLY  MAIN-
TAINED  IN  OR  NEAR  THE HOUSEHOLD OF THE PERSON OR OWNER WHO CARES FOR
SUCH OTHER DOMESTICATED ANIMAL SHALL BE CONSIDERED WILDLIFE PURSUANT  TO
THIS  PARAGRAPH.  A  FERAL CAT OR DOG SHALL MEAN ANY DOMESTICATED CAT OR
DOG THAT IS BORN IN THE WILD AND IS NOT SOCIALIZED, IS THE OFFSPRING  OF
A  DOMESTICATED CAT OR DOG AND IS NOT SOCIALIZED, OR IS A FORMERLY OWNED
DOMESTICATED CAT OR DOG THAT HAS BEEN ABANDONED AND IS NO LONGER SOCIAL-
IZED.
  S 2. This act shall take effect immediately.
