AN  ACT  to amend the education law, in relation to providing for infla-
  tionary increases in library aid

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The education law is amended by adding a new section 286 to
read as follows:
  S  286. COST-OF-LIVING ADJUSTMENT FOR LIBRARY AID. 1.  DEFINITIONS. AS
USED IN THIS SECTION:
  A. "BASE YEAR" MEANS  THE  CALENDAR  YEAR  IMMEDIATELY  PRECEDING  THE
CALENDAR  YEAR  FOR WHICH AN APPORTIONMENT OF AID IS TO BE PAID PURSUANT
TO THIS SECTION.
  B. "CONSUMER PRICE INDEX" MEANS THE REGIONAL CONSUMER PRICE INDEX  FOR
THE  NEW  YORK,  NEW  YORK-NORTHEASTERN, NEW JERSEY AREA, BASED UPON THE
INDEX FOR ALL URBAN CONSUMERS  (CPI-U),  AS  DETERMINED  BY  THE  UNITED
STATES DEPARTMENT OF LABOR.
  C. "COST-OF-LIVING ADJUSTMENT FACTOR" MEANS THE PERCENTAGE INCREASE IN
THE  CONSUMER PRICE INDEX OVER THE PERIOD COMMENCING DECEMBER FIRST, TWO
THOUSAND NINE AND ENDING ON DECEMBER FIRST OF THE  BASE  YEAR,  PROVIDED
THAT SUCH FACTOR SHALL NOT BE LESS THAN ZERO.
  D.  "TOTAL  APPORTIONMENT  OF LIBRARY AID" MEANS THE SUM OF ALL APPOR-
TIONMENTS PAYABLE TO A LIBRARY, LIBRARY SYSTEM OR OTHER ELIGIBLE  INSTI-
TUTION PROVIDING LIBRARY SERVICES FOR THE CURRENT CALENDAR YEAR PURSUANT
TO SECTION TWO HUNDRED SEVENTY-ONE, TWO HUNDRED SEVENTY-TWO, TWO HUNDRED
SEVENTY-THREE,  TWO  HUNDRED SEVENTY-THREE-A, TWO HUNDRED EIGHTY-FOUR OR
TWO HUNDRED EIGHTY-FIVE OF THIS PART.
  2. CALCULATION OF COST-OF-LIVING ADJUSTMENT.  FOR THE YEAR  COMMENCING
JANUARY FIRST, TWO THOUSAND ELEVEN, AND ANNUALLY THEREAFTER, IN ADDITION
TO  ANY  OTHER  APPORTIONMENTS  PURSUANT  TO  THIS  PART, EVERY LIBRARY,
LIBRARY SYSTEM AND OTHER ELIGIBLE INSTITUTION SHALL BE ELIGIBLE  FOR  AN
