BILL NUMBER: S1257 TITLE OF BILL : An act to amend the education law, in relation to limiting the use of standardized tests for purposes of promotion and establishes criteria for a high school diploma PURPOSE : To limit the use of standardized tests for purposes of promotion and to expand the criteria for assessing academic performance on high stakes exit exams. SUMMARY OF PROVISIONS : Section one adds a new section 3204-a to the education law. Subdivisions 1 and 2 limit the use of standardized tests for promotion in grades k-8 and requires that any decision to promote a student shall take into consideration a child's academic performance in the classroom. Subdivision 3 provides that the criteria to be used shall be determined by the Commissioner and transmitted to all school districts. Subdivisions 4 directs that the score on a regents exam that is required for a high school diploma shall be a composite score, the components of which shall be as follows: the grade on the required regents exam to be worth 75%; and course work as determined by the

SALAND -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to limiting the use of standardized tests for purposes of promotion and establishes criteria for a high school diploma THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 3204-a to read as follows: S 3204-A. LIMITATION ON THE USE OF STANDARDIZED TESTS FOR PURPOSES OF PROMOTION; CRITERIA FOR HIGH SCHOOL DIPLOMA. 1. IN ALL PUBLIC SCHOOLS FROM KINDERGARTEN THROUGH THE EIGHTH GRADE, NO DECISION OR DETERMINATION AS TO THE PROMOTION OF A PUPIL TO A HIGHER GRADE SHALL BE BASED SOLELY ON THE OUTCOME OF A PUPIL'S PERFORMANCE ON A SINGLE STANDARDIZED TEST. 2. ANY DECISION OR DETERMINATION AS TO THE PROMOTION OF A PUPIL TO A HIGHER GRADE SHALL TAKE INTO CONSIDERATION THE QUALITY AND QUANTITY OF THE PUPIL'S CUMULATIVE ACADEMIC PERFORMANCE, INCLUDING BUT NOT LIMITED TO THE FOLLOWING COMPONENTS THEREOF: A. ATTENDANCE; B. CLASSROOM TESTS; C. CLASS PROJECTS OR PORTFOLIOS; D. CLASS PARTICIPATION; AND E. EXTRA-CURRICULAR WORK. 3. THE COMMISSIONER SHALL PROMULGATE REGULATIONS FOR THE CRITERIA TO BE USED PURSUANT TO SUBDIVISION TWO OF THIS SECTION AND SHALL TRANSMIT SUCH REGULATIONS TO EACH SCHOOL DISTRICT WITHIN THE STATE. 4. A REGENTS COMPOSITE SCORE AS CALCULATED PURSUANT TO THIS SUBDIVI- SION SHALL BE CONSIDERED THE REGENTS SCORE ON SUCH REGENTS EXAMS AS THE COMMISSIONER MAY REQUIRE FOR PURPOSES OF A HIGH SCHOOL DIPLOMA.
