AN ACT to amend chapter 276 of the laws of 1993 relating to  authorizing
  the  town  of Cheektowaga, county of Erie, to lease certain park lands
  in such town, in relation to extending such authorization

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Paragraph  (a) of section 1 of chapter 276 of the laws of
1993 relating to authorizing the town of Cheektowaga, county of Erie, to
lease certain park lands in such town, as amended by chapter 455 of  the
laws of 2001, is amended to read as follows:
  (a)  Notwithstanding  the  provisions of any general, special or local
law to the contrary, the town of Cheektowaga, county of Erie, acting  by
and  through its town board, is hereby authorized and empowered to lease
to Garrett LLC the park lands described in section two of this act for a
period of no more than [thirty] FORTY years for the purposes of develop-
ing and operating a golf course  and  related  facilities  open  to  the
public.  The town of Cheektowaga is hereby authorized to execute a lease
of such lands for fair market value and upon such other terms and condi-
tions as the town board deems fair and reasonable.
  S 2. This act shall take effect immediately.
