Allows the department of transportation, in conjunction with the department of agriculture and markets, to investigate and resolve any barriers to bulk milk transportation; enables the state department of transportation and the NYC department of transportation to jointly establish weight standards for bulk milk haulers traveling within NYC.

  printed to be committed to the Committee on Agriculture

AN ACT to amend the agriculture and markets  law,  in  relation  to  the
  powers  and  duties  of the commissioner; and to amend the vehicle and
  traffic law in relation to the transportation of bulk milk

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Subdivision 4 of section 16 of the agriculture and markets
law, such section as renumbered by chapter 16 of the laws  of  1935,  is
amended to read as follows:
  4.  Investigate  the  sources  of  food  supply  for  the  state,  the
production, transportation, storage, marketing and distribution of  food
sold,  offered  for  sale,  stored or held within the state, the cost OR
BARRIERS of transportation to the leading centers of population  and  of
distribution to consumers.
  S  2. Subdivision 11 of section 16 of the agriculture and markets law,
as amended by chapter 267 of the laws of 1970, is  amended  to  read  as
follows:
  11.  Co-operate  with the commissioner of transportation with the view
of obtaining suitable, expeditious and  economical  facilities  for  the
shipment  of  food,  and  recommend as to the action to be taken by such
commissioner to avoid and prevent unfair discrimination in such shipment
and unreasonable delay OR BARRIERS in the transportation thereof, and to
obtain fair and reasonable rates for such transportation.
  S 3. Paragraph (d) of subdivision 15 of section 385 of the vehicle and
traffic law, as amended by section 3 of part C of chapter 59 of the laws
of 2004, is amended to read as follows:
  (d) Except during storms, floods, fires or other  public  emergencies,
no  such  permit  may  be issued to include a towing operation involving
more than two vehicles except three vehicle combinations consisting of a
tractor, semitrailer and trailer or a tractor and  two  trailers  within
