AN ACT to amend the public health law, in relation to patient  notifica-
  tion  of services provided by non-participating providers at a partic-
  ipating hospital

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  public health law is amended by adding a new section
2805-t to read as follows:
  S 2805-T. NOTIFICATION OF NON-PARTICIPATING PROVIDERS PROVIDING TREAT-
MENT AT A PARTICIPATING HOSPITAL. EVERY HOSPITAL SHALL  BE  REQUIRED  TO
NOTIFY A PATIENT ADMITTED TO SUCH HOSPITAL IF A PHYSICIAN OR HEALTH CARE
PROVIDER  PROVIDING  TREATMENT  TO  SUCH  PATIENT IS NOT A PARTICIPATING
PROVIDER IN THE NETWORK OF ANY INSURER WHOSE PLANS OR POLICIES OF INSUR-
ANCE ARE ACCEPTED BY SUCH HOSPITAL. THE NOTIFICATION  REQUIRED  BY  THIS
SECTION  SHALL BE PRIOR TO SUCH PHYSICIAN OR HEALTH CARE PROVIDER TREAT-
ING THE PATIENT.
  S 2. This act shall take effect on the sixtieth  day  after  it  shall
have become a law.
