BILL NUMBER: S3593 TITLE OF BILL : An act to amend the environmental conservation law, in relation to recycling rechargeable batteries PURPOSE : To require New York State residents to recycle rechargeable batteries instead of disposing of them as solid waste. This law requires rechargeable battery manufacturers to work in partnership with New York retailers to set up a free, easily accessible recycling network for residents. New York retailers that sell rechargeable batteries (or products containing rechargeable batteries) to collect rechargeable batteries for recycling from consumers. Retailers are required to post and maintain, at or near the point of entry to the place of business, a legible sign stating that used rechargeable batteries of the size and shape sold or offered by the retailer may not enter the solid waste stream, and that the retail establishment is a collection site for recycling such batteries at no-cost to the consumer. Retailers are required to conspicuously maintain a collection box or other suitable receptacle easily accessible by customers, into which consumers may deposit used rechargeable batteries. The title heading of title 17 of article 27 of the environ- mental conservation law, as added by chapter 152 of the laws of 1990, is amended to read as follows: [LEAD-ACID] BATTERY RECYCLING S 2. The environmental conservation law is amended by adding a new section 27-1703 to read as follows: S 27-1703. RECHARGEABLE BATTERIES. 1. DEFINITIONS. WHEN USED IN THIS SECTION: A. "AUTHORIZED HAZARDOUS WASTE FACILITY" MEANS ANY HAZARDOUS WASTE TREATMENT, STORAGE AND DISPOSAL FACILITY PERMITTED PURSUANT TO SECTION 27-0913 OF THIS ARTICLE WHICH IS AUTHORIZED TO ACCEPT BATTERIES. B. "COLLECTOR" MEANS ANY PERSON WHO ACCEPTS BATTERIES IN ORDER TO TRANSFER THEM TO A RECYCLING FACILITY, AN AUTHORIZED HAZARDOUS WASTE FACILITY OR ANOTHER COLLECTOR. C. "CONSUMER" MEANS ANY PERSON WHO PURCHASES RECHARGEABLE BATTERIES FOR USE OTHER THAN RESALE. D. "DISPOSE" OR "DISPOSAL" MEANS THE ABANDONMENT, DISCHARGE, DEPOSIT, INJECTION, DUMPING, SPILLING, LEAKING OR PLACING OF ANY SUBSTANCE SO THAT SUCH SUBSTANCE OR ANY RELATED CONSTITUENT THEREOF MAY ENTER THE ENVIRONMENT. DISPOSAL ALSO MEANS THE THERMAL DESTRUCTION OF WASTE OR HAZARDOUS WASTE AND THE BURNING OF SUCH WASTES AS FUEL FOR THE PURPOSE OF RECOVERING USEABLE ENERGY. The legis- lature finds and declares that the presence of toxic metals in discarded rechargeable batteries is a matter of great concern in light of their adverse effect on groundwater quality when disposed of in landfills and their presence in emissions or residual ash when incinerated at a resource recovery facility; that cadmium, lead and mercury found in rechargeable batteries, on the basis of available scientific and medical evidence, are of particular concern; that it is desirable to reduce the toxic state of waste materials in the solid waste streams directed to resource recovery and sanitary landfill facilities; that the removal of used rechargeable batteries containing high levels of cadmium, lead or mercury from the solid waste stream can have a significant beneficial impact on the quality of the emissions and residual ash resulting from the incineration of solid waste at resource recovery facilities, and on groundwater quality in those regions where solid waste is disposed at sanitary landfill facilities; and that the most effective and appropri- ate method to promote the reduction of toxic metals from rechargeable battery disposal is to require the battery industry to accept the finan- cial responsibility for the environmentally sound collection, transpor- tation and recycling or proper disposal of discarded rechargeable batteries.
