BILL NUMBER: S4634 TITLE OF BILL : An act to amend the education law, in relation to authorizing boards of cooperative educational services to enter into contracts with public libraries for high-speed telecommunications services and community relations services PURPOSE : To grant to any Board of Cooperative Educational Services (BOCES), the ability to enter into contracts with public or association libraries or library systems to provide telecommunications services as well as community relations services. SUMMARY OF PROVISIONS : Section 1 amends paragraph h of subdivision 4 of section 1950 of education law by adding a new subparagraph 8 which grants to boards of cooperative educational services (BOCES) ,the ability to enter into contracts with public or association libraries or library systems to provide telecommunications services as well as community relations services. EXISTING LAW : Currently BOCES are not authorized to enter into these types of contracts.

OPPENHEIMER -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to authorizing boards of cooperative educational services to enter into contracts with public libraries for high-speed telecommunications services and community relations services THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph h of subdivision 4 of section 1950 of the educa- tion law is amended by adding a new subparagraph 8 to read as follows: (8) TO ENTER INTO CONTRACTS WITH INDIVIDUAL PUBLIC LIBRARIES OR PUBLIC LIBRARY SYSTEMS FOR THE PURPOSE OF PROVIDING: (I) HIGH-SPEED TELECOMMU- NICATIONS SERVICES INCLUDING, BUT NOT LIMITED TO, HIGH-SPEED INTERNET SERVICES AND ANY OTHER TYPES OF TELECOMMUNICATIONS SERVICE OR SYSTEM; AND/OR (II) COMMUNITY RELATIONS SERVICES. FOR THE PURPOSES OF THIS SUBPARAGRAPH "COMMUNITY RELATIONS SERVICES" SHALL MEAN THAT SUCH LIBRARIES OR LIBRARY SYSTEMS, EITHER INDIVIDUALLY OR COOPERATIVELY, MAY MORE EFFECTIVELY AND COST EFFECTIVELY ESTABLISH COMMUNITY OUTREACH PROGRAMS TO DISSEMINATE INFORMATION ON THE STRENGTHS OF UTILIZING PUBLIC LIBRARIES AS A POSITIVE EDUCATIONAL TOOL AND RESOURCE FOR STUDENTS AND THE GENERAL PUBLIC. ANY SUCH PROPOSED CONTRACT SHALL BE SUBJECT TO THE REVIEW AND APPROVAL OF THE COMMISSIONER, WHO MAY ONLY APPROVE SUCH PROPOSED CONTRACT WHEN, IN SUCH COMMISSIONER'S OPINION, SUCH CONTRACT WILL RESULT IN: (A) A MORE ECONOMICAL UTILIZATION OF EXISTING BOARD OF COOPERATIVE EDUCATIONAL SERVICES HIGH-SPEED TELECOMMUNICATIONS OR COMMU- NITY RELATION SERVICES OR RESOURCES; AND (B) A MORE ECONOMICAL UTILIZA- TION OF EXISTING LIBRARY RESOURCES. THE COMMISSIONER SHALL ISSUE A FIND- ING, IN WRITING, MAKING ANY DETERMINATION PURSUANT TO THIS SUBPARAGRAPH. S 2.
