BILL NUMBER: S6926 TITLE OF BILL : An act in relation to allowing certain undersheriffs in the county of Chemung to join the special retirement plan for sheriffs, undersheriffs and deputy sheriffs PURPOSE : To allow certain deputy sheriffs of the county of Chemung to join the special retirement plan for sheriffs, undersheriffs,and deputy sheriffs. SUMMARY OF PROVISIONS : Section 1 of the bill authorizes the county of Chemung as a participating employer in the New York State and Local Employees' Retirement System, pursuant to section 551 of the retirement and social security law, to offer a special retirement plan for sheriffs, undersheriffs, and deputy sheriffs engaged in law enforcement activities. Specifically, participation in such a retirement plan would be made available to Michael Skrosknik. E. Scott Smith, Joseph Dieterle, Richard Mathews, Kasey Slater, Ryan Wheeler, James Ritter, and John M. Allen; deputy sheriffs employed by the county of Chemung. Section 2 of the bill provides that all employer costs associated with implementing the provisions of this act shall be borne by the county

O'MARA -- read once and referred to the Committee on Governmental Employees AN ACT in relation to allowing certain undersheriffs in the county of Chemung to join the special retirement plan for sheriffs, undersher- iffs and deputy sheriffs THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law, Michael Skrosk- nik, E. Scott Smith, Joseph Dieterle, Richard Mathews, Kasey Slater, Ryan Wheeler, James Ritter and John M. Allen, who are each employed as a deputy sheriff in the county of Chemung, and who, are each a member of the New York state and local employees' retirement system, and who, were each eligible to make the election pursuant to section 551 of the retirement and social security law to join the special retirement plan for sheriffs, undersheriffs and deputy sheriffs engaged in law enforce- ment activities, but who, for reasons not ascribable to their own indi- vidual negligence, failed to make such election to join such special retirement plan, shall each be eligible to individually join such special retirement plan if on or before December 31, 2010 he or she files a written request with the state comptroller to that effect. S 2. All costs incurred by the implementation of this act shall be borne by the county of Chemung. S 3. This act shall take effect immediately. FISCAL NOTE.--This bill will authorize Chemung County to reopen the provisions of Section 551 of the Retirement and Social Security Law for deputy sheriffs Michael Skrosknik, E. Scott Smith, Joseph Dieterle, Richard Mathews, Kasey Slater, Ryan Wheeler, James Ritter, and John M. Allen who are currently not covered by that Section. Notwithstanding any other provision of law to the contrary, the county of Chemung, a participating employer in the New York state and local police and fire retirement system, which previously elected to offer the optional twenty-five year retirement plan established pursuant to section 551 of the retirement and social security law, to sheriffs, undersheriffs and deputy sheriffs employed by such county, is hereby authorized to make participation in such plan available to Michael Skrosknik, E. Scott Smith, Joseph Dieterle, Richard Mathews, Kasey Slater, Ryan Wheeler, James Ritter and John M. Allen, deputy sheriffs employed by the county of Chemung, who, for reasons not ascribable to their own negligence failed to make timely application to participate in such optional twenty-five year retirement plan. The county of Chemung may so elect by filing with the state comptroller, on or before December 31, 2010, a resolution of the Chemung county legislature together with certification that such deputy sheriffs did not bar themselves from participation in such retirement plan as a result of their own negli- gence. Thereafter, such deputy sheriffs may elect to be covered by the provisions of section 551 of the retirement and social security law, and shall be entitled to the full rights and benefits associated with cover- EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
