AN ACT to amend the executive  law  and  the  social  services  law,  in
  relation  to  developing  plans  to adequately address military sexual
  trauma experienced by female veterans

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.    Section 353 of the executive law is amended by adding a
new subdivision 21 to read as follows:
  21. TO DEVELOP AND ENCOURAGE PLANS FOR ASSISTANCE AND  BENEFITS  WHICH
ADEQUATELY  ADDRESS  MILITARY SEXUAL TRAUMA EXPERIENCED BY FEMALE VETER-
ANS.
  S 2. The social services law is amended by adding a new section 179 to
read as follows:
  S 179. ASSISTANCE TO FEMALE VETERANS. PURSUANT TO SUBDIVISION  TWENTY-
ONE  OF  SECTION  THREE  HUNDRED  FIFTY-THREE  OF THE EXECUTIVE LAW, ANY
VETERAN ORGANIZATION DEFINED IN SUBDIVISION THREE OF SECTION ONE HUNDRED
SIXTY-EIGHT OF THIS TITLE  SHALL  PROVIDE  ASSISTANCE  AND  BENEFITS  TO
FEMALE  VETERANS WHICH ADEQUATELY ADDRESS MILITARY SEXUAL TRAUMA EXPERI-
ENCED BY SUCH VETERANS AS DEVELOPED BY THE STATE DIRECTOR  OF  VETERANS'
AFFAIRS OR HIS OR HER AGENT.
  S 3. This act shall take effect immediately.

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section 353 of the executive law is amended by adding two
new subdivisions 21 and 22 to read as follows:
  21. TO DEVELOP AND DIRECT GENDER  SPECIFIC  PROGRAMMING  AT  VETERANS'
AFFAIRS  MEDICAL  FACILITIES  WHERE SUCH PROGRAMMING IS DEEMED NECESSARY
AND APPLICABLE, AND WOULD BEST FACILITATE THE RECOVERY OF FEMALE  VETER-
ANS  WHO  HAVE  EXPERIENCED  MILITARY SEXUAL TRAUMA. FOR THE PURPOSES OF
THIS ARTICLE, MILITARY SEXUAL TRAUMA SHALL  MEAN  PSYCHOLOGICAL  TRAUMA,
WHICH IN THE JUDGMENT OF A VETERANS' AFFAIRS MENTAL HEALTH PROFESSIONAL,
RESULTED  FROM A PHYSICAL ATTACK OF A SEXUAL NATURE, BATTERY OF A SEXUAL
NATURE OR SEXUAL HARASSMENT WHICH OCCURRED WHILE THE VETERAN WAS SERVING
ON ACTIVE DUTY OR ON ACTIVE DUTY FOR TRAINING.
  22. TO ENSURE THAT ALL PROFESSIONAL  STAFF  EMPLOYED  AT  A  VETERANS'
AFFAIRS  MEDICAL  FACILITY  IS  EDUCATED  AND PROPERLY TRAINED ABOUT THE
EFFECTS OF MILITARY SEXUAL TRAUMA AND THE TREATMENT OF SUCH CONDITION.
  S 2. The social services law is amended by adding a new section 179 to
read as follows:

TARY  SEXUAL  TRAUMA.  SUCH  INFORMATION  SHALL BE POSTED ON THE VETERAN
AFFAIRS' WEBSITE. FOR THE PURPOSES  OF  THIS  ARTICLE,  MILITARY  SEXUAL
TRAUMA  SHALL  MEAN  PSYCHOLOGICAL  TRAUMA,  WHICH  IN THE JUDGMENT OF A
VETERANS' AFFAIRS MENTAL HEALTH PROFESSIONAL, RESULTED FROM  A  PHYSICAL
ATTACK  OF A SEXUAL NATURE, BATTERY OF A SEXUAL NATURE OR SEXUAL HARASS-

  to adequately address military sexual  trauma  experienced  by  female

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1.   Section 7.09 of the mental  hygiene  law  is  amended  by
adding two new subdivisions (k) and (l) to read as follows:
  (K) THE COMMISSIONER SHALL PROMULGATE RULES AND REGULATIONS TO DISSEM-
INATE  INFORMATION  TO FEMALE VETERANS, WHEN APPLICABLE, REGARDING WHICH
VETERANS' AFFAIRS CENTERS AND OTHER ORGANIZATIONS SUCH  FEMALE  VETERANS
CAN SEEK TREATMENT, COUNSELING AND RESOURCES FOR MILITARY SEXUAL TRAUMA.
SUCH  INFORMATION SHALL BE POSTED ON THE OFFICE'S WEBSITE WITH A LINK TO
THE WEBSITE OF THE UNITED STATES DEPARTMENT OF VETERANS  AFFAIRS  AND  A
LINK TO THE WEBSITE OF THE STATE DIVISION OF VETERANS' AFFAIRS.  FOR THE
PURPOSES  OF  THIS ARTICLE, MILITARY SEXUAL TRAUMA SHALL MEAN PSYCHOLOG-
ICAL TRAUMA, WHICH IN THE JUDGMENT  OF  A  MENTAL  HEALTH  PROFESSIONAL,
