LATIMER -- read once and referred to the Commit- tee on Health AN ACT to amend the public health law, in relation to excluding money raised by fundraising for volunteer emergency medical services when allocating state funding THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 3005-c to read as follows: S 3005-C. FUNDRAISING BY VOLUNTEER AMBULANCE COMPANIES. 1. FOR PURPOSES OF THIS SECTION A "FUNDRAISING ACTIVITY" MEANS A METHOD OF RAISING FUNDS TO EFFECTUATE THE LAWFUL PURPOSES OF A VOLUNTEER AMBULANCE COMPANY, BUT SHALL NOT INCLUDE ANY METHOD PROHIBITED BY THE STATE CONSTITUTION OR THE PENAL STATUTES OF THIS STATE, OR THE CONDUCT OF A BUSINESS OR OTHER COMMERCIAL ENTERPRISE EXCEPT ON TEMPORARY BASIS FOR A PERIOD OR PERIODS NOT TO EXCEED A TOTAL OF NINETY DAYS IN ANY CALENDAR YEAR. 2. MONIES GENERATED FROM FUNDRAISING ACTIVITIES SHALL NOT BE CONSID- ERED WHEN DETERMINING STATE AID OR REIMBURSEMENT FOR SERVICES TO PARTIC- IPATING VOLUNTEER AMBULANCE COMPANIES, INCLUDING REGIONAL EMERGENCY MEDICAL COUNCILS.
