N. RIVERA, CRESPO, LINARES, CASTRO, J. RIVERA, P. RIVERA, ARROYO, RAMOS, RODRIGUEZ, MOYA -- read once and referred to the Committee on Education AN ACT providing for the creation of a temporary state commission on the energy costs savings for school districts and providing for the repeal of such provisions upon the expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. A temporary state commission, to be known as the commission on alternative energy cost savings for schools in New York state, here- inafter referred to as the commission, is hereby created to, in consul- tation with the New York state department of education, examine, evalu- ate, make recommendations and to collect data concerning the cost savings of school districts if each school utilized alternative energy technologies including but not limited to, solar panels and advanced- technology miniature wind turbines, to help offset energy cost currently incurred by each school. S 2. The commission shall consist of fifteen members, to be appointed as follows: nine members to be appointed by the governor, four of which shall be staff from the New York state department of education or the New York state energy research and development authority and five of which shall be members of green energy technology firms and environ- mental conservation not-for-profit organizations operating in the state of New York; two members to be appointed by the temporary president of the senate; two members to be appointed by the speaker of the assembly; one member to be appointed by the minority leader of the senate; and one member to be appointed by the minority leader of the assembly. S 3. The commission shall be housed at and staffed by the New York state energy research and development authority. The public authorities law is amended by adding a new section 1867-b to read as follows: S 1867-B. ENERGY COST SAVINGS FOR SCHOOL DISTRICTS REPORT. 1. THE AUTHORITY SHALL EXAMINE, EVALUATE, MAKE RECOMMENDATIONS AND COLLECT DATA CONCERNING COST SAVINGS TO SCHOOL DISTRICTS IF SUCH SCHOOL DISTRICTS UTILIZED ALTERNATIVE ENERGY TECHNOLOGIES INCLUDING BUT NOT LIMITED TO, SOLAR PANELS AND ADVANCED-TECHNOLOGY MINIATURE WIND TURBINES. 2. THE AUTHORITY SHALL CREATE A REPORT, CONTAINING THE INFORMATION AND DATA COLLECTED PURSUANT TO SUBDIVISION ONE OF THIS SECTION, TO BE SUBMITTED TO THE GOVERNOR, THE TEMPORARY PRESIDENT OF THE SENATE, THE SPEAKER OF THE ASSEMBLY, THE MINORITY LEADER OF THE SENATE AND THE MINORITY LEADER OF THE ASSEMBLY NO LATER THAN JULY THIRTY-FIRST, TWO THOUSAND THIRTEEN. 3. SUCH REPORT, AT A MINIMUM, SHALL INCLUDE: A. THE ALTERNATIVE ENERGY TECHNOLOGIES THAT SHOULD BE USED; B. Paragraph (f) of subdivision 17 of section 1005 of the public authorities law, as added by chapter 477 of the laws of 2009 and such subdivision as renumbered by section 16 of part CC of chapter 60 of the laws of 2011, is amended to read as follows: (f) The authority shall complete and submit a report, on or before [January thirty-first, two thousand twelve, on those activities under- taken pursuant to this subdivision to the governor, the speaker of the assembly, the temporary president of the senate, the minority leader of the senate, the minority leader of the assembly, the chair of the senate finance committee, the chair of the assembly ways and means committee, the chair of the assembly energy committee and the chair of the senate EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
