AN  ACT  to  amend  the  environmental  conservation law, in relation to
  implementing a demonstration drug disposal program; and providing  for
  the repeal of such provisions upon the expiration thereof

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Title 27 of article 27 of  the  environmental  conservation
law, as added by chapter 625 of the laws of 2008, is amended by adding a
new section 27-2705 to read as follows:
S 27-2705. DEMONSTRATION DRUG DISPOSAL PROGRAM.
  1.  THE  DEPARTMENT,  IN  CONSULTATION  WITH THE DIVISION OF THE STATE
POLICE, SHALL NO LATER THAN JUNE FIRST, TWO  THOUSAND  THIRTEEN,  ESTAB-
LISH,  OR ENTER INTO CONTRACTS FOR THE ESTABLISHMENT OF, A DEMONSTRATION
DRUG DISPOSAL PROGRAM TO DETERMINE THE MOST  EFFECTIVE  METHOD  FOR  THE
DISPOSAL  OF DRUGS.   SUCH PROGRAM SHALL INCLUDE THE CREATION OF NO LESS
THAN THREE DEMONSTRATION DRUG DISPOSAL SITES  TO  BE  AVAILABLE  TO  THE
PUBLIC  AND LOCATED IN STATE POLICE FACILITIES. THE STATE POLICE FACILI-
TIES TO BE USED FOR THE DEMONSTRATION DRUG  DISPOSAL  PROGRAM  SHALL  BE
LOCATED  IN  AREAS THAT ARE GEOGRAPHICALLY DIVERSE AND REPRESENTATIVE OF
RURAL, SUBURBAN AND URBAN AREAS. SUCH PROGRAM SHALL BE IN PLACE FOR  ONE
YEAR.
  2.   IN ADDITION TO ANY EXISTING INFORMATION CONCERNING DRUG DISPOSAL,
THE DEPARTMENT SHALL MAINTAIN A LIST OF STATE POLICE FACILITIES  PARTIC-
IPATING IN THE DEMONSTRATION DRUG DISPOSAL PROGRAM AS WELL AS ANY INFOR-
MATION  REGARDING  DRUG  DISPOSAL  PROCEDURES FOR SUCH FACILITIES ON ITS
WEBSITE.
  3. AT THE CLOSE OF THE  DEMONSTRATION  PROGRAM  THE  DEPARTMENT  SHALL
PREPARE  A  REPORT  DETAILING:  THE  QUANTITIES  OF DRUGS COLLECTED; THE
EFFECTIVENESS OF  EACH  FACILITY  LOCATION;  INFORMATION  DETAILING  THE
ACCEPTANCE  METHODS  MADE AVAILABLE AND RECOMMENDATIONS FOR ANY LEGISLA-
TIVE ACTION.
  S 2. This act shall take effect immediately and shall  expire  and  be
deemed repealed December 31, 2014.
