BILL NUMBER:S3134 TITLE OF BILL: An act to amend the criminal procedure law, in relation to persons designated as peace officers PURPOSE OR GENERAL IDEA OF BILL: This bill would grant peace officer status to the security officers of the Kaleida Health Centers. SUMMARY OF SPECIFIC PROVISIONS: Amends Section 2.10 of the Criminal Procedure Law by adding a subdivision that includes under peace officer status all persons employed by the Kaleida Health Network as members of its security force. The new subdivision stipulates that such officers are not authorized to carry. possess, repair or dispose of a firearm without an appropriate license issued under Section 400.00 of the Penal Law, or to authorize such officer to carry or possess a firearm except while on duty. Section 2.10 of the criminal procedure law is amended by adding a new subdivision 83 to read as follows: 83. MEMBERS OF THE SECURITY FORCE EMPLOYED BY KALEIDA HEALTH WITHIN THE FOLLOWING HEALTH SYSTEMS: BUFFALO GENERAL HOSPITAL, WOMEN AND CHIL- DREN'S HOSPITAL OF BUFFALO, MILLARD FILLMORE GATES CIRCLE HOSPITAL, MILLARD FILLMORE SUBURBAN HOSPITAL, DEGRAFF MEMORIAL HOSPITAL AND DEACO- NESS LONG TERM CARE; PROVIDED HOWEVER, THAT NOTHING IN THIS SUBDIVISION SHALL BE DEEMED TO AUTHORIZE SUCH OFFICER TO CARRY, POSSESS, REPAIR OR DISPOSE OF A FIREARM UNLESS THE APPROPRIATE LICENSE THEREFOR HAS BEEN ISSUED PURSUANT TO SECTION 400.00 OF THE PENAL LAW. S 2. This act shall take effect on the one hundred eightieth day after it shall have become a law. THESE OFFICERS SHALL ONLY HAVE THE POWERS LISTED IN PARAGRAPH (C) OF SUBDIVISION ONE OF SECTION 2.20 OF THIS ARTICLE, AS WELL AS THE POWER TO DETAIN AN INDIVIDUAL FOR A REASONABLE PERIOD OF TIME WHILE AWAITING THE ARRIVAL OF LAW ENFORCEMENT, PROVIDED THAT THE OFFICER HAS ACTUAL KNOWLEDGE, OR PROBABLE CAUSE TO BELIEVE, THAT SUCH INDIVIDUAL HAS COMMITTED AN OFFENSE; PROVIDED HOWEVER, THAT NOTHING IN THIS SUBDIVISION SHALL BE DEEMED TO AUTHORIZE SUCH OFFICER TO CARRY, POSSESS, REPAIR OR DISPOSE OF A FIREARM UNLESS THE APPROPRIATE LICENSE THEREFOR HAS BEEN ISSUED PURSUANT TO SECTION 400.00 OF THE PENAL LAW.
