BILL NUMBER:S4640 TITLE OF BILL: An act to amend the education law, in relation to licensure of perfusionists PURPOSE: To provide a requirement and procedure for New York State licensure of perfusionists, who operate the equipment that supports the heart and lungs during certain medical procedures. SUMMARY OF PROVISIONS: The bill would amend the education law by adding a new article 134 containing Sections 6630 through 6636. Section 6630 provides definitions relevant to the practice of perfusion. Section 6631 establishes procedures and qualifications for licensure. Section 6632 provides that only a person licensed or exempt under this article shall practice perfusion or use the title of "licensed perfusionist."

The legislature hereby finds and declares that the public interest requires the regulation of the prac- tice of perfusion and the establishment of clear licensure standards for perfusionists; and that the health and welfare of the residents of the state will be protected by identifying to the public those individuals who are qualified and legally authorized to practice perfusion. BILL NUMBER:S4640C TITLE OF BILL: An act to amend the education law, in relation to licensure of perfu- sionists; and providing for the repeal of such provisions upon expira- tion thereof PURPOSE: Amends the education law to allow perfusionists to directly perform laboratory tests necessary to their job of running machines essential to certain procedures (e.g. open heart surgery and organ transplants). SUMMARY OF PROVISIONS: Section 1: Amends section 8609 of the education law by adding new subdi- vision 9. This addition allows perfusionists working under the super- vision of a physician to acquire a temporary permit to perform essential tests in the operating room. Section 2. Establishes the effective date. JUSTIFICATION: Recent changes to the education law that required certain laboratory tests to be performed by licensed professionals had the unintended consequence of forbidding perfusionists from directly performing tests essential to the proper operation of machines they operate during

THE PERFORMANCE OF, USE OF, AND ANALYSIS OF THE RESULTS FROM POINT OF CARE TESTS AND INSTRUMENTS USED TO MONITOR COAGULATION, BLOOD GAS AND BLOOD CHEMISTRY AND HEMOGLOBIN AND HEMATOCRIT PURSUANT TO AN ORDER AND UNDER THE DIRECTION AND SUPERVISION OF A LICENSED PHYSICIAN BY INDIVID- UALS EMPLOYED ON A SALARIED BASIS BY A HOSPITAL AND ISSUED A PERMIT BY THE DEPARTMENT. SUCH PERMIT SHALL BE ISSUED FOR A PERIOD OF TWO YEARS TO INDIVIDUALS WHO SUBMIT AN APPLICATION WHICH INCLUDES AN ATTESTATION BY THE APPLICANT'S EMPLOYER THAT THE APPLICANT IS EMPLOYED ON A SALARIED BASIS BY A HOSPITAL IN NEW YORK STATE, AND MEETS THE QUALIFICATIONS ESTABLISHED BY SUCH HOSPITAL TO PERFORM EXTRACORPOREAL OR INTRACORPOREAL SERVICES UNDER THE DIRECTION AND SUPERVISION OF A LICENSED PHYSICIAN. SUCH PERMIT SHALL BE SUBJECT TO FULL DISCIPLINARY AND REGULATORY AUTHOR- ITY OF THE BOARD OF REGENTS AND THE DEPARTMENT, PURSUANT TO THIS TITLE, EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
