An act
approving the exchange of certain lands between National Grid and the
People of the State of New York
PURPOSE:
This legislation allows National Grid to deed to the state
approximately 20 acres of forest land currently owned by the company
in exchange for the six acres of forest preserve land bordering
County Route 56 and a utility light of way over a two mile stretch in
St.
Lawrence County. Without the exchange of land, the utility would have
had to re-route the construction of a new transmission line around
the forest preserve. As a result, a large track of forested land
would have had been clear cut to accommodate a new transmission line
deemed necessary to provide reliable service to the Central
Adirondacks. The legislation allows for the transaction between the
state and the utility as authorized in a constitutional amendment
approved by the people of the State of New York in 2009.
SUMMARY OF PROVISIONS:
The legislation authorizes the state to convey close to six acres of
forest preserve land that adjoins County Route 56 in St. Lawrence
County to the utility. In exchange National Grid will convey to the
state for incorporation into the forest preserve approximately 20 acres of forest land in St. Lawrence County. The lands have been identified by National Grid and reviewed by the New York State Department of Environmental Conservation which has deemed them to be at least in equal value as required by the Constitutional Amendment. JUSTIFICATION: To ensure reliable electrical service year-round to certain communities in the Adirondacks, including Tupper Lake and Lake Placid, it was necessary for National Grid to construct a new 46kV power line. This power line in large part runs along St. Lawrence County's Route 56. However, there is a two mile stretch where the right-of-way along the side of County Route 56 was not large enough to accommodate the new power line without impinging on forest preserve lands. Without the swapping of the identified land, National Grid alternative plan would have run the power line around the forest preserve lands, resulting in a seventy-five foot wide swath of land being cleared along a six mile stretch of sensitive forest boreal habitat. A 2009 constitutional amendment approved by the voters of the State of New York allowed for a much more environmentally viable alternative whereby a shorter, less expensive, less damaging route could be utilized. The current legislation allows for the transaction to occur between the state and the utility and the exchange of land to take place. The acreage being conveyed to the state will join state lands in two areas in the Town of Piercefield that are currently divided by a National Grid/Niagara Mohawk right away. The adjacent lands that will remain in National Grid ownership split parcels of land owned by two separate timber companies that have granted the State of New York Conservation Easements. National Grid has expressed a willingness to discuss future land transfer with the timber company to allow for these tracks of land to also be joined into one parcel. The construction of the project was done in conjunction with the New York Power Authority. Following the completion of the land transfer, ownership of the line will be approved by the New York Power Authority and upon approval by the Federal Energy Regulatory Commission, the line will be owned in whole by National Grid. AN ACT approving the exchange of certain lands between National Grid and
the People of the State of New York
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Pursuant to section 1 of article 14 of the state constitu-
tion, as amended, the legislature approves the lands to be exchanged as
specified in this act and finds and determines that the property to be
received by the State, described in section four of this act, is true
and forest land and is at least equal in value to the land conveyed by
the State to National Grid, described in section five of this act. The
legislature further finds that all provisions and requirements of the
constitution relating to this exchange have been met.
S 2. The commissioner of general services, after certification to him
or her by the commissioner of environmental conservation that title to
the lands described in section four of this act has vested in the People
of the State of New York, shall issue letters patent to National Grid of
the lands described in section five of this act.
Notwithstanding the provisions of the public lands law, the conveyance
by the state may be without reservation of any minerals.
S 3. Title to the land described in section four shall be approved by
the attorney general, and the deed to the People of the State of New
York of such lands shall be approved by the attorney general as to form
and manner of execution and recordability prior to its delivery to the
St. Lawrence county clerk for recording.

Commencing at a point marked by a 4" iron pipe & stones at the divi-
sion line between the Towns of Piercefield and Colton, said point mark-
ing the southwesterly corner of lands of the People of the State of New
York recorded as Document No. 1999-9532 at the St. Lawrence County

ration to Paul Smith's Electric Light and Power and Railroad Company by
deed dated September 17, 1953 and recorded in the St. Lawrence County
Clerk's Office on September 21, 1953 in Liber 520 of Deeds, Page 11. A
subsequent deed reserves the 150' wide strip of land for the Pierce-
field-Tupper Lake Transmission Line to Niagara Mohawk Power Corporation
by deed dated December 29, 1969 from Niagara Mohawk Power Corporation to
Paul Smith's College of Arts and Sciences, said deed being recorded in
the St. Lawrence County Clerk's Office on February 18, 1970 in Book 834
of Deeds, Page 115. Intending to convey that portion of the above 150'
wide strip passing within and running through the State lands along the

Corporation located north of the above said parcel and north of the
Raquette River; said 25' wide access strip for ingress and egress to be
extinguished if/when said lands north of the Raquette River are conveyed
and combined with the adjoining lands which are now or formerly owned by
Timbervest TVP II New York, LLC and if/when said strip lands are
conveyed and combined with adjoining lands which are now or formerly
owned by Lyme Adirondack Timberland I for the remaining strip located
between the Raquette River and north of the above described 7.18 acre
parcel.
The description of the lands to be conveyed contained in this section
4 is not intended to be a legal description, but is intended to identify
the parcels to be conveyed. As a condition of conveyance National Grid
shall submit to the commissioner for his or her approval a description
based upon an accurate survey of the lands generally described in this
section, which may be used in the conveyance thereof.

An act
approving the exchange of certain lands between National Grid and the
People of the State of New York
PURPOSE:
This legislation allows National Grid to deed to the state
approximately 20 acres of forest land currently owned by the company
in exchange for the six acres of forest preserve land bordering
County Route 56 and a utility light of way over a two mile stretch in
St. Lawrence County. Without the exchange of land, the utility would
have had to re-route the construction of a new transmission line
around the forest preserve. As a result, a large track of forested
land would have had been clear cut to accommodate a new transmission
line deemed necessary to provide reliable service to the Central
Adirondacks. The legislation allows for the transaction between the
state and the utility as authorized in a constitutional amendment
approved by the people of the State of New York in 2009.
SUMMARY OF PROVISIONS:
The legislation authorizes the state to convey close to six acres of
forest preserve land that adjoins County Route 56 in St. Lawrence
County to the utility. In exchange National Grid will convey to the
state for incorporation into the forest preserve approximately 20
acres of forest land in St. Lawrence County. The lands have been identified by National Grid and reviewed by the New York State Department of Environmental Conservation which has deemed them to be at least in equal value as required by the Constitutional Amendment. JUSTIFICATION: To ensure reliable electrical service year-round to certain communities in the Adirondacks, including Tupper Lake and Lake Placid, it was necessary for National Grid to construct a new 46kV power line. This power line in large part runs along St. Lawrence County's Route 56. However, there is a two mile stretch where the right-of-way along the side of County Route 56 was not large enough to accommodate the new power line without impinging on forest preserve lands. Without the swapping of the identified land, National Grid alternative plan would have run the power line around the forest preserve lands, resulting in a seventy-five foot wide swath of land being cleared along a six mile stretch of sensitive forest boreal habitat. A 2009 constitutional amendment approved by the voters of the State of New York allowed for a much more environmentally viable alternative whereby a shorter, less expensive, less damaging route could be utilized. The current legislation allows for the transaction to occur between the state and the utility and the exchange of land to take place. The acreage being conveyed to the state will join state lands in two areas in the Town of Piercefield that are currently divided by a National Grid/Niagara Mohawk right away. The adjacent lands that will remain in National Grid ownership split parcels of land owned by two separate timber companies that have granted the State of New York Conservation Easements. National Grid has expressed a willingness to discuss future land transfer with the timber company to allow for these tracks of land to also be joined into one parcel. The construction of the project was done in conjunction with the New York Power Authority. Following the completion of the land transfer, ownership of the line will be approved by the New York Power Authority and upon approval by the Federal Energy Regulatory Commission, the line will be owned in whole by National Grid. AN ACT approving the exchange of certain lands between National Grid and
the People of the State of New York
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Pursuant to section 1 of article 14 of the state constitu-
tion, as amended at the general election held in November, 2009, the
legislature approves the lands to be exchanged as specified in this act
and finds and determines that the property to be received by the state,
described in section four of this act, is true and forest land and is at
least equal in value to the land conveyed by the state to National Grid,
described in section five of this act. The legislature further finds
that all provisions and requirements of the constitution relating to
this exchange have been met.
S 2. The commissioner of general services, after certification to him
or her by the commissioner of environmental conservation that title to
the lands described in section four of this act has vested in the people
of the state of New York, shall issue letters patent to National Grid of
the lands described in section five of this act.
Notwithstanding the provisions of the public lands law, the conveyance
by the state may be without reservation of any minerals. The letters
patent shall contain the following covenants and restrictions:
(a) The property shall be used as a utility corridor and for no other
purpose.
(b) National Grid shall not sell, transfer or subdivide the property,
except for the sale or transfer of the property to any affiliate or

subsidiary of National Grid or a person or entity utilizing the property

18, 1970 in Book 834 of Deeds, Page 115. Intending to convey that
portion of the above referenced 150' wide strip passing within and
running through the State lands along the Raquette River Corridor
(1999-9532) as shown on NYSDEC Map No. 11,377, Sheet 2 of 5 Sheets
prepared for the New York State Department of Environmental Conservation
by Thomas J. Kovoch, NYSPLS No. 49092, copies of said map being filed at
the New York State Department of Environmental Conservation Offices in
Albany and Watertown. The above said NYSDEC Map No. 12,275 was recorded
in the St. Lawrence County Clerk's Office on December 9, 2010 in File
R-2010-00018587.
Excepting and reserving to Niagara Mohawk Power Corporation, DBA
National Grid an easement for ingress and egress over a 25' wide strip
of land over the west side of the above described lands for access to
and from a remaining portion of the 150' wide strip of lands located
north of the above said parcel and north of the Raquette River which are
not being conveyed to the State of New York by this exchange and
containing 2.15 acres of land more or less; said 25' wide access strip
for ingress and egress to be extinguished if/when said lands north of
the Raquette River are conveyed and combined with the adjoining lands
