BILL NUMBER:S5240 TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to temporary beer and wine permits PURPOSE: This bill would allow wine manufacturers who produce not more than 150,000 gallons of wine annually to participate and sell wine at special events for a permit fee of $26. SUMMARY OF PROVISIONS: Section 97 of the Alcohol and Beverage Law, as amended by chapter 183 of the laws of 2008 is amended by adding a new subdivision 4. Section 1: Authorizes the State Liquor Authority to issue a permit to the holder of any license to manufacture wine to sell wine at outdoor or indoor events and gatherings, provided that such manufacturer produces less than 150,000 gallons of wine annually. The permit fee would be $26. Section 2: This Act shall take effect immediately. STATEMENT IN SUPPORT:

THE LIQUOR AUTHORITY IS HEREBY AUTHORIZED TO ISSUE A PERMIT UNDER THIS SECTION TO ANY HOLDER OF A LICENSE TO MANUFACTURE WINE IN THIS OR ANY OTHER STATE, TO SELL WINE AT OUTDOOR OR INDOOR GATHERINGS, FUNC- TIONS, OCCASIONS, OR EVENTS, PROVIDED THAT SUCH MANUFACTURER PRODUCES NOT MORE THAN ONE HUNDRED FIFTY THOUSAND GALLONS OF WINE ANNUALLY. THE FEE FOR SUCH PERMIT SHALL BE TWENTY-SIX DOLLARS. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
