BILL NUMBER:S5342 TITLE OF BILL: An act to amend the parks, recreation and historic preservation law, in relation to draft management plan submission dates PURPOSE OR GENERAL IDEA OF BILL: This bill will change the date by which the Michigan Street African American Heritage Corridor Commission must submit for approval to the commissioner a draft management plan. The plan must be submitted by December 31, 2011. SUMMARY OF SPECIFIC PROVISIONS: This bill amends section one subdivision 2 of section 41.09 of the parks, recreation and historic preservation law, as added by chapter 595 of the laws of 2007. The draft management plan shall be submitted to the commissioner for approval by December 31, 2011. JUSTIFICATION: The Michigan Street Corridor Commission was designated as part New York's systems of heritage areas in 2007. The Commission encompasses the geographical corridor of the east side of downtown Buffalo, in Erie County. It encompasses the J. Edward Nash House, the

GRISANTI -- read twice and ordered printed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation AN ACT to amend the parks, recreation and historic preservation law, in relation to draft management plan submission dates THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 41.09 of the parks, recreation and historic preservation law, as added by chapter 595 of the laws of 2007, is amended to read as follows: 2. The draft management plan shall be submitted to the commissioner for approval [within four years of the effective date of this article] BY DECEMBER THIRTY-FIRST, TWO THOUSAND ELEVEN. Prior to submitting the plan to the commissioner, the legislative representative body of the city of Buffalo must approve the plan. The legislative body of the city of Buffalo, at its discretion and in the interest of expediting the local approval process, shall hold two public meetings at any time during the local approval process. The commissioner may approve the plan, may return the plan to the commission with recommendations for approval, or may reject the plan. A copy of the approved plan shall be provided to the governor, the temporary president of the senate and the speaker of the assembly. S 2. This act shall take effect immediately provided, however, that the amendments to subdivision 2 of section 41.09 of the parks, recre- ation and historic preservation law made by section one of this act shall not affect the repeal of such article and shall be deemed repealed therewith.
