TITLE OF BILL:
An act
to amend the parks, recreation and historic preservation law, in
relation to extending draft management plan submission dates and to
amend chapter 595 of the laws of 2007 relating to establishing the
Michigan Street African American Heritage Corridor commission in
Buffalo, in relation to the effectiveness thereto

PURPOSE OR GENERAL IDEA OF BILL:
This bill will change the date by
which the Michigan Street African American Heritage Corridor
Commission must submit for approval to the Commissioner a draft
management plan and change the date when Article 41 expires to
conform to such date. The plan must be submitted by July 31, 2013.

SUMMARY OF SPECIFIC PROVISIONS:
This bill amends section one
subdivision 2 of Section 41.09 of the Parks, Recreation and Historic
Preservation Law, as added by Chapter 595 of the Laws of 2007. The
draft management plan shall be submitted to the Commissioner for
approval by July 31, 2013. The bill amends Section 3 of Chapter 595
of the Laws of 2007 to extend Article 41 of the Parks, Recreation
and Historic Preservation Law to December 31, 2013.

JUSTIFICATION:
The Michigan Street African American Heritage
Corridor Commission was designated as part of New York's system of
heritage area in 2007. The Commission encompasses the geographical
east side of downtown Buffalo, in Erie County. It encompasses the
J. Edward Nash House, Michigan Street Baptist Church and the Colored
Musicians Club, associated with and revealing of a historic role as
the center of African-American history, culture and reform
activities. The importance of the Commission's mission to develop the
heritage corridor to function as a destination for both academic
research and tourism is imperative. To further the Commission's
purpose, it must have a dedicated funding source.

This legislation would give the Michigan Street African American
Heritage Corridor Commission additional time to submit their plan to
the Commissioner for approval.

PRIOR LEGISLATIVE HISTORY:
None.

FISCAL IMPLICATIONS:
None to the State.

EFFECTIVE DATE:
This act will take effect immediately, with provisions.

AN ACT to amend the parks, recreation and historic preservation law,  in
  relation  to  extending  draft management plan submission dates and to
  amend chapter 595 of the laws of 2007  relating  to  establishing  the
  Michigan  Street  African  American  Heritage  Corridor  commission in
  Buffalo, in relation to the effectiveness thereto

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 2 of section 41.09 of the parks, recreation and
historic  preservation  law,  as  amended  by chapter 438 of the laws of
2011, is amended to read as follows:
  2. The draft management plan shall be submitted  to  the  commissioner
for  approval by [December thirty-first, two thousand eleven] JULY THIR-
TY-FIRST, TWO THOUSAND THIRTEEN. Prior to submitting  the  plan  to  the
commissioner, the legislative representative body of the city of Buffalo
must  approve  the plan. The legislative body of the city of Buffalo, at
its discretion and in the interest  of  expediting  the  local  approval
process,  shall  hold  two  public meetings at any time during the local
approval process. The commissioner may approve the plan, may return  the
plan  to the commission with recommendations for approval, or may reject
the plan. A copy of the approved plan shall be provided to the governor,
the temporary president of the senate and the speaker of the assembly.
  S 2. Section 3 of chapter 595 of the laws of 2007, relating to  estab-
lishing  the  Michigan Street African American Heritage Corridor commis-
sion in Buffalo, is amended to read as follows:
  S 3. This act shall take effect immediately, provided that section two
of this act shall expire and be deemed repealed [April 30] DECEMBER  31,
[2012] 2013.
  S  3.  This act shall take effect immediately, except that if this act
shall have become a law on or after December 31,  2011  this  act  shall
take  effect  immediately and shall be deemed to have been in full force

 EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

                      [ ] is old law to be omitted.

and effect on and after December 31, 2011, and provided further that the
amendments to subdivision 2 of section 41.09 of  the  parks,  recreation
and  historic preservation law made by section one of this act shall not
affect  the  repeal  of such article and shall be deemed repealed there-
with.

ation and historic preservation law, as added by chapter 595 of the laws
of 2007, is amended to read as follows:
  The  commission is hereby established as a not-for-profit corporation.
The commission shall be governed by the not-for-profit  corporation  law
except  where  such  law  conflicts with this article, in which case the
provisions of this article shall govern. The commission shall consist of
up to [eleven] TWELVE  voting  members  and  six  non-voting  ex-officio
members.  One member each shall be appointed by the governor, the tempo-
rary president of the senate, and the speaker  of  the  assembly.  Other
members  shall  include  the mayor of the city of Buffalo, or his or her
designee, a representative of museum studies at the state university  of
New  York  College  at Buffalo, two representatives of the department of
Afro-American studies at the state university of New York at Buffalo,  a
representative  from  the  Monroe Fordham regional history center at the
state university of New York College at Buffalo,  and  a  representative

from  each board governing the J. Edward Nash House, the Michigan Street
Baptist Church, THE LANGSTON HUGHES INSTITUTE, and the Colored Musicians
Club. All appointments shall be residents of the city  of  Buffalo,  but
the  commission  has  the  authority  to  waive  this requirement at its
discretion. In addition, six non-voting MEMBERS shall serve  ex-officio:
the secretary of state, the commissioners of the office of parks, recre-
ation  and  historic  preservation, environmental conservation, economic
development and education, and the president of the  city  of  Buffalo's
convention and visitor's bureau, or their designees. Appointments to the
commission  shall  be  filed with the commissioner who shall convene the
first meeting of the commission following the filing of  a  majority  of
the  appointments. At the initial meeting, the members of the commission
shall elect officers.
  S 2. Subdivision 2 of section  41.09  of  the  parks,  recreation  and
historic  preservation  law,  as  amended  by chapter 438 of the laws of
2011, is amended to read as follows:
  2. The draft management plan shall be submitted  to  the  commissioner

one  of  this  act  and  to subdivision 2 of section 41.09 of the parks,
recreation and historic preservation law made by section two of this act
shall not affect the repeal of such article and shall be deemed repealed
therewith.

state  university  of  New York College at Buffalo, and a representative
from each board governing the J. Edward Nash House, [the Michigan Street
Baptist  Church,]  THE  LANGSTON HUGHES INSTITUTE, and the Colored Musi-
cians Club. All appointments shall be residents of the city of  Buffalo,
but  the  commission  has the authority to waive this requirement at its
discretion. In addition, [six]  SEVEN  non-voting  MEMBERS  shall  serve
ex-officio:  the  secretary of state, the commissioners of the office of
parks, recreation and historic preservation, environmental conservation,
economic development and education, [and] the president of the  city  of
Buffalo's  convention  and  visitor's  bureau, or their designees, AND A
REPRESENTATIVE OF THE MICHIGAN STREET BAPTIST CHURCH.   Appointments  to
the  commission  shall  be filed with the commissioner who shall convene
the first meeting of the commission following the filing of  a  majority
of  the appointments. At the initial meeting, the members of the commis-
sion shall elect officers.
  S 2. Subdivision 2 of section  41.09  of  the  parks,  recreation  and
historic  preservation  law,  as  amended  by chapter 438 of the laws of
2011, is amended to read as follows:
  2. The draft management plan shall be submitted  to  the  commissioner
for  approval by [December thirty-first, two thousand eleven] JULY THIR-
TY-FIRST, TWO THOUSAND THIRTEEN. Prior to submitting  the  plan  to  the
commissioner, the legislative representative body of the city of Buffalo
must  approve  the plan. The legislative body of the city of Buffalo, at
its discretion and in the interest  of  expediting  the  local  approval
process,  shall  hold  two  public meetings at any time during the local
approval process. The commissioner may approve the plan, may return  the
plan  to the commission with recommendations for approval, or may reject
the plan. A copy of the approved plan shall be provided to the governor,
the temporary president of the senate and the speaker of the assembly.
  S 3. Section 3 of chapter 595 of the laws of 2007, amending the parks,
recreation and historic preservation law relating  to  establishing  the
Michigan   Street  African  American  Heritage  Corridor  commission  in
Buffalo, is amended to read as follows:
  S 3. This act shall take effect immediately, provided that section two
of this act shall expire and be deemed repealed [April 30, 2012]  DECEM-
BER 31, 2013.
  S  4.  This  act  shall take effect immediately and shall be deemed to
have been in full force and effect  on  and  after  December  31,  2011;
provided  that  the amendments to the opening paragraph of section 41.05
of the parks, recreation and historic preservation law made  by  section
one  of  this  act  and  to subdivision 2 of section 41.09 of the parks,
recreation and historic preservation law made by section two of this act
shall not affect the repeal of such article and shall be deemed repealed
therewith.
