TITLE OF BILL:
An act
to amend the
criminal procedure law, in relation to designating certain employees of
the Seneca county sheriff's office as peace officers

PURPOSE OR GENERAL IDEA OF BILL:
To grant peace officer status to
uniformed marine patrol officers, uniformed court security officers
and uniformed security officers employed by the Seneca County
Sheriffs Office.

SUMMARY OF SPECIFIC PROVISIONS:
Section one amends section 2.10 of the
Criminal Procedure Law by adding a new subdivision 83, designating
uniformed marine patrol officers employed by the Seneca County
Sheriffs Office as peace officers.

Section one also amends section 2.10 of the Criminal Procedure Law by
adding a new subdivision 84, designating the uniformed court security
officers employed by the Seneca County Sheriffs Office as peace
officers.

Section one also amends section 2.10 of the Criminal Procedure Law by

adding a new subdivision 85, designating the uniformed security
officers employed by the Seneca County Sheriffs Office as peace
officers.

Section two contains the effective date.

JUSTIFICATION:
Under this proposal, uniformed marine patrol officer,
court security officers, and security officers employed by the Seneca
County Sheriffs Office would be given peace officer status. This
designation is necessary to facilitate the many security services
these officers provide.

This legislation has been requested by the Seneca County Sheriffs
Office. Similar legislation has been enacted to extend peace officer
status to marine patrol and security personnel employed by various
counties and local governments across the State.

PRIOR LEGISLATIVE HISTORY:
This is a new bill.

FISCAL IMPLICATIONS:
None.

EFFECTIVE DATE:

This act shall take effect immediately.

AN ACT to amend the criminal procedure law, in relation  to  designating
  certain employees of the Seneca county sheriff's office as peace offi-
  cers

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1.  Section 2.10 of the criminal procedure law is  amended  by
adding three new subdivisions 83, 84 and 85 to read as follows:
  83.  EMPLOYEES  APPOINTED BY THE SHERIFF OF SENECA COUNTY, PURSUANT TO
THEIR SPECIAL  DUTIES  SERVING  AS  UNIFORMED  MARINE  PATROL  OFFICERS;
PROVIDED,  HOWEVER,  THAT NOTHING IN THIS SUBDIVISION SHALL BE DEEMED TO
AUTHORIZE SUCH OFFICER TO CARRY, POSSESS, REPAIR OR DISPOSE OF A FIREARM
UNLESS THE APPROPRIATE LICENSE  HAS  BEEN  ISSUED  PURSUANT  TO  SECTION
400.00 OF THE PENAL LAW OR TO AUTHORIZE SUCH OFFICER TO CARRY OR POSSESS
A FIREARM EXCEPT WHILE ON DUTY.
  84.  EMPLOYEES  OF  THE  SENECA  COUNTY  SHERIFF'S  OFFICE  SERVING AS
UNIFORMED COURT SECURITY OFFICERS AT  SENECA  COUNTY  COURT  FACILITIES;
PROVIDED,  HOWEVER,  THAT NOTHING IN THIS SUBDIVISION SHALL BE DEEMED TO
AUTHORIZE SUCH OFFICERS TO  CARRY,  POSSESS,  REPAIR  OR  DISPOSE  OF  A
FIREARM UNLESS THE APPROPRIATE LICENSE THEREFOR HAS BEEN ISSUED PURSUANT
TO SECTION 400.00 OF THE PENAL LAW.

UNIFORMED SECURITY OFFICERS AT SENECA COUNTY OFFICE BUILDINGS; PROVIDED,

SUCH  OFFICERS  TO CARRY, POSSESS, REPAIR OR DISPOSE OF A FIREARM UNLESS
