BILL NUMBER:S6249 REVISED 01/19/12 TITLE OF BILL: An act to amend the education law, in relation to authorizing the board of trustees of the university of Rochester to designate security staff as peace officers PURPOSE OR GENERAL IDEA OF BILL: To authorize uniformed campus-security staff at the University of Rochester to make arrests and carry safety equipment. SUMMARY OF SPECIFIC PROVISIONS: Adds Section 6311 to the education law in order to give the board of trustees at the University of Rochester authority to appoint one or more security personnel as peace officers as set forth in section 2.20 of the criminal procedure law, after the officers have completed a necessary training course. Permits said peace officers to carry pepper foam and a baton if so authorized by the president of the University. Paragraph 2 outlines the manner of appointment of university peace officers. Paragraph 3 outlines the manner of revocation of a peace officer's designation as such. Paragraph 4 outlines the authority of university peace officers in relation to other peace officers and police officers. Paragraph 5 outlines limits of the legislation in reference to collective bargaining agreements and other employee agreements. Section 2 establishes the effective date.

ALESI -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to authorizing the board of trustees of the university of Rochester to designate security staff as peace officers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 6311 to read as follows: S 6311. DESIGNATION OF PEACE OFFICERS AT THE UNIVERSITY OF ROCHESTER. 1. THE BOARD OF TRUSTEES OF THE UNIVERSITY OF ROCHESTER SHALL HAVE THE AUTHORITY TO APPOINT SECURITY OFFICERS FOR SUCH UNIVERSITY AND, IN ITS DISCRETION, TO DESIGNATE OR TO REVOKE THE DESIGNATION OF ONE OR MORE THAN ONE SECURITY OFFICER AS A PEACE OFFICER. A SECURITY OFFICER SO DESIGNATED SHALL HAVE THE POWERS OF A PEACE OFFICER AS SET FORTH IN SECTION 2.20 OF THE CRIMINAL PROCEDURE LAW. A SECURITY OFFICER DESIG- NATED AS A PEACE OFFICER MUST HAVE SATISFACTORILY COMPLETED OR COMPLETE, WITHIN ONE YEAR OF THE DATE OF SUCH DESIGNATION, A COURSE OF LAW ENFORCEMENT TRAINING PRESCRIBED BY THE MUNICIPAL POLICE TRAINING COUNCIL IN CONSULTATION WITH THE UNIVERSITY BOARD OF TRUSTEES. A PEACE OFFICER SO DESIGNATED MAY POSSESS AND CARRY A BATON AND PEPPER FOAM AS A PART OF ON DUTY EMPLOYMENT ONLY IF AUTHORIZED TO DO SO BY THE PRESIDENT OF THE UNIVERSITY. THE GEOGRAPHICAL AREA OF EMPLOYMENT OF A PEACE OFFICER SO DESIGNATED IS THE CAMPUS AND OTHER PROPERTY OF THE UNIVERSITY, INCLUDING THAT PORTION OF A PUBLIC HIGHWAY WHICH CROSSES OR ABUTS SUCH PROPERTY, AND RESIDENTIAL OR OTHER FACILITIES OWNED, OPERATED OR MAINTAINED BY A NOT-FOR-PROFIT ENTITY ASSOCIATED WITH THE UNIVERSITY OF ROCHESTER FOR WHICH SUCH UNIVERSITY PROVIDES SECURITY. 2. THE APPOINTMENT OF SECURITY OFFICERS AT THE UNIVERSITY OF ROCHESTER SHALL BE GOVERNED BY AND CONFORM WITH CIVIL SERVICE LAWS, RULES AND REGULATIONS, IF APPLICABLE TO THE UNIVERSITY AND ITS EMPLOYEES. THE DESIGNATION OF A SECURITY OFFICER AS A PEACE OFFICER SHALL BE BASED ON QUALIFICATIONS ESTABLISHED BY THE UNIVERSITY BOARD OF TRUSTEES, AND IN ACCORDANCE WITH SENIORITY. SUMMARY OF SPECIFIC PROVISIONS: Sections 1 of the bill would amend the Criminal Procedure Law to authorize the Board of Trustees of the University of Rochester to designate as peace officers those security services officers who shall satisfy the peace officer training requirements and a course of instruction in public and private law enforcement. Designated peace officers would be required to abide by requirements mutually agreed upon between the chief law enforcement officer of the applicable local law enforcement jurisdiction. The bill would provide that the peace officers would be limited to use such powers on property owned, controlled or administered by the University of Rochester and on a highway which crosses or adjoins such University
