TITLE OF BILL:
An act
in relation to authorizing the conveyance of real property at the State
University of New York College of Environmental Science and Forestry

PURPOSE:
To authorize the exchange of parcels of realty between the State of
New York, on behalf of the State University of New York College of
Environmental Science and Forestry ("SUNY ESF"), and Syracuse
University to facilitate development of an academic research building
for SUNY ESF.

SUMMARY OF PROVISIONS:
Section 1 of the legislation provides that, notwithstanding the
provisions of any other law, the State of New York may convey to
Syracuse University a parcel of real property, now owned or to be
owned by the State, under the jurisdiction of SUNY ESF, described in
section 2 of the legislation, in exchange for the conveyance by
Syracuse University to the State, for the benefit of SUNY ESF, or a
parcel of real property described in section 3 of the legislation,
upon such terms and conditions as the parties may agree.

Section 4 of the legislation provides that it shall take effect
immediately.

EXISTING LAW:
The Public Lands Law ("PLL") governs the manner in which the State of
New York may convey title lands owned by the State. Once a State
entity determines that land is no longer useful or necessary for the
purposes of the State entity (PLL 30-A), the Commissioner of General
Services is authorized to sell the property at public auction (PLL
33(1) or to convey title to a municipality for certain uses (PLL 34)

JUSTIFICATION:
The purpose of this legislation is to authorize the exchange of
parcels of real property between the State of New York and Syracuse
University to facilitate development of an academic research building
for SUNY ESF. In absence of the legislation, SUNY ESF
would lack authority to convey its parcel to Syracuse University since
the provisions of the Public Lands Law would otherwise apply.

The legislation allows SUNY ESF to exchange a parcel of land now owned
or to be owned by the State and under the jurisdiction of SUNY ESF
for a similar parcel of land owned by adjacent Syracuse University.
SUNY ESF is constructing a new 120,000 square foot academic research
building that will foster educational and research opportunities and
provide the college with a mission critical facility that the College
is unable to provide with its current facilities. The College is in
the process of acquiring a 1.62 parcel located a block bordered by
Stadium Place, Henry Street, Raynor Street and Standart Street in the
City of Syracuse. The SUNY ESF property is not continguous to the ESF
campus; however it is continuous to the Syracuse University campus.
Syracuse University owns a 1.62 acre property located on the block
bordered by Standart Street, Fineview Place, Oakland Street, and


Stadium Place in the City of Syracuse. This property is currently
being used to provide surface parking for the University's faculty,
staff, students, and visitors. This Syracuse University parcel is
continguous to the SUNY ESF campus and directly opposite SUNY ESF's
Centennial Hall, the College's new student residence facility. Both
parties consider such an exchange of
property advantageous for their respective campus projects.
The Syracuse University 1.62 acre site affords much greater
opportunities for integration of the academic research building with
the rest of the SUNY ESF campus. An exchange of properties is
critical to the integration of the academic research building with
the rest of the SUNY ESF campus and would create an uninterrupted
campus quad as described in the College's Facilities Master Plan.

To date, the State has appropriated $44,000,000 for the construction
of the College's academic research building.

By resolutions adopted June 15, 2011 and November 22, 2011, the State
University of New York Board of Trustees has expressed its support of
the exchange of properties between the State and Syracuse University
to facilitate development of the academic research building.

Syracuse University supports the legislation. However, any agreement
of exchange is subject to the approval of the Board of Trustees of
Syracuse University.

AN ACT in relation to authorizing the conveyance of real property at the
  State  University  of  New  York  College of Environmental Science and
  Forestry

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Notwithstanding  any other provision of law, the state of
New York is authorized to convey to Syracuse University all its  rights,
title  and  interest  in  the  real  property  and  improvements thereon
described as Parcel A in section two of this act, now owned  or  in  the
future  to  be owned by the state of New York and under the jurisdiction
of the State University of New York College of Environmental Science and
Forestry, in exchange for the conveyance by Syracuse University  to  the
state  of  New York, for the benefit of the State University of New York
College of Environmental Science and Forestry, of all its rights,  title
and  interest in the real property and improvements thereon described as
Parcel B in section three of this act,  owned  by  Syracuse  University,
upon  such  terms and conditions as the parties shall agree. The convey-
ances authorized by this act shall not be subject to the approval of the
attorney general as to any matter, other than title, or to the  approval
of  the  state  comptroller  as to any matter, and may be made upon such
terms and conditions as the state of New York  and  Syracuse  University
may agree.
  S  2.  The property authorized by this act to be conveyed by the state
of New York to Syracuse University is generally described s a parcel  of
real  property  with  improvements  thereon, consisting of approximately
1.62 acres, located in the City of  Syracuse,  County  of  Onondaga,  as
follows.  Bound  by  Standart  Street  to the south, Henry Street to the
west, East Raynor Avenue to the north, and Stadium Place  to  the  east,
being more particularly described as follows:

ty  of  Onondaga and State of New York, being block 605 in said City and
being more particularly described as follows: Beginning at  a  point  in
the  existing  southerly  line of Raynor Avenue at its intersection with
the  existing  westerly  line  of  Stadium Place, said point also being,
South 72°01'21" West a distance of 0.36 feet from said existing City  of
Syracuse  concrete  monument;  thence,  South  03°44'57"  East along the
existing westerly line of Stadium Place a distance of 268.00 feet  to  a
point  on  the existing northerly line of Standart Street; thence, South
86°21'13" West along the northerly line of Standart Street a distance of
264.00 feet to a point on the easterly line  of  Henry  Street;  thence,
North  03°45'17" West along the easterly line of Henry Street a distance
of 268.00 feet to a point  on  the  southerly  line  of  Raynor  Avenue;
thence, North 86°21'13" East along the southerly line of Raynor Avenue a
distance  of  264.03  feet  to  the point of beginning, containing 1.624
acres.

of New York, in exchange for the conveyance of the property by the state

thereon, consisting of approximately 1.62 acres, located in the City  of
Syracuse,  County  of  Onondaga,  as follows: Generally described as the
eastern most portion of the parcel bounded by  Standart  Street  to  the
north, Stadium Place to the east, Oakland Street to the south, and Fine-
view Place to the west, being more particularly described as follows:

All that tract or parcel of land, situate in the City of Syracuse, Coun-
ty  of  Onondaga  and State of New York, being a portion of block 609 in
said City and being more particularly described as follows:    Beginning
at  a  point  in  the  existing southerly line of Standart Street at its
intersection with the westerly line  of  Stadium  Place;  thence,  South
0°06'03"  West  along  the  westerly line of Stadium Place a distance of
134.04 feet to a point; thence, South 03°44'57"  East  continuing  along
the  west  line of Stadium Place a distance of 141.60 feet to a point on
the northerly line of Oakland Street; thence, South 86°13'23" West along
the north line of Oakland Street a distance of 254.70 feet to  a  point;
thence, through the property of Syracuse University (reputed owner) on a
bearing  of North 03°39'58" West a distance of 275.93 feet to a point on
the southerly line of Standart  Street;  thence,  North  86°21'13"  East
along the south line of Standart Street a distance of 263.30 feet to the
