BILL NUMBER:S7095 TITLE OF BILL: An act to amend the mental hygiene law, in relation to the disposal of drugs, drug disposal sites and home pharmaceutical collection PURPOSE OR GENERAL IDEA OF BILL: To increase public awareness on the proper disposal of drugs and drug disposal sites. SUMMARY OF SPECIFIC PROVISIONS: Section 1 of this bill would amend mental hygiene law by adding a new subdivision (i) that will require the Office of Alcoholism and Substance Abuse Services (OASAS) in cooperation with the Department of Environ- mental Conversation (DEC) to post on their agency website information related to conducting a pharmaceutical collection event. It will also allow OASAS to assist DEC in the development of a public information program on the proper disposal of drugs and drug disposal sites. Section 2 of this bill makes this act take effect on the one hundred twentieth day after it shall have become law. JUSTIFICATION: The National Survey on Drug Use and Health (NSDUH) shows that nearly one-third of people aged 12 and over who used drugs for the first time in 2009 began by using a prescription drug non-medically. KLEIN -- read twice and ordered printed, and when printed to be committed to the Committee on Alcoholism and Drug Abuse AN ACT to amend the mental hygiene law, in relation to the disposal of drugs, drug disposal sites and home pharmaceutical collection THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 19.09 of the mental hygiene law is amended by adding a new subdivision (i) to read as follows: (I) (1) THE OFFICE, IN COOPERATION WITH THE DEPARTMENT OF ENVIRON- MENTAL CONSERVATION, SHALL POST ON THE OFFICE WEBSITE INFORMATION WHICH INCLUDES BUT IS NOT LIMITED TO THE REQUIRED STEPS AND GUIDELINES FOR ANY MUNICIPALITY, PHARMACY, LOCAL LAW ENFORCEMENT AGENCY, OR COMMUNITY GROUP TO CONDUCT A HOUSEHOLD PHARMACEUTICAL COLLECTION EVENT. (2) PURSUANT TO SECTION 27-2703 OF THE ENVIRONMENTAL CONVERSATION LAW, AS ADDED BY CHAPTER SIX HUNDRED TWENTY-FIVE OF THE LAWS OF TWO THOUSAND EIGHT, THE COMMISSIONER, IN CONSULTATION WITH THE DEPARTMENT MAY ASSIST IN THE DEVELOPMENT OF A PUBLIC INFORMATION PROGRAM ON THE PROPER DISPOSAL OF DRUGS AND DRUG DISPOSAL SITES. THE OFFICE SHALL DISSEMINATE SUCH INFORMATION BY ANY MEANS DEEMED APPROPRIATE BY THE COMMISSIONER. S 2. This act shall take effect on the one hundred twentieth day after it shall have become a law. Effective immediately, the addition, amend- ment and/or repeal of any rule or regulation necessary for the implemen- tation of this act on its effective date is authorized to be made on or before such date.
