TITLE OF BILL:
An act
to amend the public authorities law, in relation to authorizing the
Suffolk county water authority to sell water in bulk at public events at
its regular retail rates or other reasonable rates or charges

PURPOSE:
To authorize the Suffolk county water authority to sell water in bulk
at public events at its regular retail rates or other reasonable
rates or charges.

SUMMARY OF PROVISIONS:
Section 1 of the bill amends subdivision 5 of section 1078 of the
public authorities law to authorize the Suffolk county water
authority to sell water in bulk to any not-for-profit corporation,
public corporation, private corporation or person at its regular
retail rates or at such other reasonable rates and charges as may be
determined by the authority. Section 2 provides the effective date.

JUSTIFICATION:
Under subdivision 5 of section 1078 of the public authorities law, the
Suffolk County water authority is currently authorized to purchase
water in bulk from any person, private corporation or municipality
when necessary and convenient for the operation of its water supply

system. However, public authorities law section 1078 is silent as to
whether the water authority may sell water in bulk to such entities.
There are a number of areas in Suffolk County where events are
sponsored for the public but public water supply mains are not
available to provide a safe supply of drinking water to such event.
The bill would make it clear that the Suffolk County water authority
is authorized to provide drinking water in bulk to such events at its
regular retail rates or at such other reasonable rates and charges as
determined by the authority.

AN  ACT  to amend the public authorities law, in relation to authorizing

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 5 of section 1078  of  the  public  authorities
law,  as added by chapter 136 of the laws of 1950, is amended to read as
follows:
  5. To purchase water in bulk from any person, private  corporation  or
municipality  when  necessary  or  convenient  for the operation of such
water supply and distribution system.   TO SELL WATER  IN  BULK  TO  ANY
NOT-FOR-PROFIT  CORPORATION,  PUBLIC CORPORATION, PRIVATE CORPORATION OR
PERSON AT ITS REGULAR RETAIL RATES OR AT SUCH OTHER REASONABLE RATES AND
CHARGES AS MAY BE DETERMINED BY THE AUTHORITY.
  S 2. This act shall take effect immediately.
