AN ACT authorizing the office of general services to convey certain land
to the American Legion Post #1113
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The office of general services is hereby authorized and
empowered to sell, convey and transfer the real property described in
section two of this act, to the American Legion Post #1113, a not-for-
profit corporation in the state of New York, for the purpose of recre-
ation, parking and other related purposes. Conveyance of said lands is
to be made for $1.00 at such time and upon such other terms and condi-
tions as the commissioner of general services may fix and determine,
including those terms and conditions described in section six of this
act, and upon the written consent of the commissioner of the office of
mental health.
S 2. Such land is more particularly described as follows: All that
certain lot, piece or parcel of land, located off Mohawk Street, in the
village of Whitesboro, County of Oneida, State of New York and bounded
and described as follows: Beginning at a point on the westerly line of
the Whitestown American Legion #1113 and the easterly line of the New
York State Mental Health Office, said point being the following courses
from the northerly line of Main Street, N 70 50' 43' E, 253.05 feet to a
point, N 28 45' 19" W, 32.53 feet to a point and N 63 44' 53" E, 67.00
feet to the point of beginning; Thence N 63 44' 53" E, 115.96 feet to a
point on the westerly line of Mohawk Street; Thence N 35 38' 18" E along
said street 96.14 feet to a point on the easterly line of the Ablete
Bird Sanctuary; Thence S 63 44' 16" W along said line 200.78 feet to a
point; Thence S 26 15' 07" E, 45.00 feet to the point of beginning. This
parcel of real property contains 7,152 square feet of land more or less.
Being the premises described in a map and description for acquisition of

real property from Lawrence S. Rieben and Gertrude G. Rieben by the
State of New York Office of Mental Health Community Residence Mohawk
Valley Psychiatric Center, approved on April 12, 1990 and filed in the
Department of Transportation on April 23, 1990. This parcel also being
the premises described in a deed from Lawrence S. Rieben and Gertrude G.
Rieben, reputed owners dated June 1, 1973, and recorded in the Oneida
county registrars office, Oneida County, as liber 1970 of deeds at page
533.
S 3. The description in sections two and seven of this act of the
lands to be conveyed are not intended to be a legal description, but are
intended only to identify the premises to be conveyed. As a condition of
purchase the American Legion Post #1113 shall submit to the commissioner
of general services for his or her approval an accurate survey and
description of the lands generally described in sections two and seven
of this act, which may be used in the conveyance thereof.
S 4. The office of general services shall not grant the aforesaid land
unless application is made therefor by the American Legion Post #1113,
within one year of the effective date of this act.
S 5. Any lands transferred to the American Legion Post #1113 pursuant
to section one of this act shall be used exclusively for the purpose of
recreation and parking by the American Legion Post #1113 of Whitesboro
and upon termination of such use of the lands so transferred shall
revert to the State of New York.
S 6. The American Legion Post #1113 located in the village of Whites-
boro, Oneida County shall transfer and convey to the New York State
Office of Mental Health a parcel of land as described in section seven
of this act.
S 7. Such land to be transferred and conveyed from the American Legion
Post #1113 to the New York State Office of Mental Health is more partic-
ularly described as follows: All that parcel of land located off Mohawk
Street in the Village of Whitesboro, County of Oneida, State of New York
and described as follows: Beginning at a point on the westerly line of
the Whitestown American Legion #1113 and the easterly line of the New
York State Mental Health Office, said point being N 70 50' 43' E, 253.05
feet from the northerly line of Main Street; Thence N 28 45' 19" W,
32.53 feet to a point and N 63 44' 53" E, 67.00 feet to a point; Thence
S 27 23' W, 73.19 feet to the point of beginning. This parcel of real
property contains 1,089 square feet of land more or less. Being the
premises described in deed from Alice B. Waterbury to the Whitestown
Post/1113, The American Legion dated September 27, 1951, and recorded in
the Oneida county registrars office, Oneida County, as the liber 1336 of
deeds at pages 193-196.
S 8. This act shall take effect immediately.
